    The year of Our Lord, 2022, begins with plenty of unknowns and an unknowable number of what Donald Rumsfeld famously called “unknown unknowns.” Will inflation continue to rise? Will the pandemic finally retreat from the headlines? Who will push harder, Joe Biden or Joe Manchin? How will the Supreme Court rule in the big abortion case from Mississippi? Will the birthrate recover? Who will win the big sports titles? Will anyone show up for the Beijing Olympics?

    In the Unites States, the midterm elections will dominate all other political considerations. Until then, every politician on the ballot will be looking for votes every waking minute. Expect more robocalls. 

    Here is one absolutely certain prediction for the year ahead: There will be weather. 

    In any event, the coming year presents an opportunity for families to love together, for children to mark yet another inch or two (or more) of growth, for churches to share the gospel, and for the press to push new headlines. Don’t miss it.

    It’s Joe Biden v. Donald Trump—redux. 

    That’s the race for the presidency.  If Joe Biden were not going to be the nominee, word would have leaked by now. For anyone who is undecided, we have something rare in politics: a controlled experiment—the tenure of both a Trump and a Biden presidency.

    Under Trump, we had a growing economy reaching and helping everyone, fuel and food prices were down, our allies confident, and our enemies contained.  You had illegal immigration receding and drug deaths—while too high—in the five figures annually. Under Biden, we had record inflation and spending; allies invaded and attacked; our enemies on the march, rewarded with billions of dollars; illegal immigration skyrocketed;  our border obliterated.  Deaths of despair have reached into the six figures annually.

    The truth is this:  there is not one single index of domestic or foreign policy under Biden that is better than during the Trump years.

    The choice should be clear.

    The annual State of the Union address combines the grandeur of our constitutional democracy and a bit of political grandstanding. It was more political grandstanding than constitutional grandeur last night when President Joe Biden delivered his State of the Union address, he knew he was facing the political challenge of his life.

    The American people are rightly concerned about his age and mental condition. The president didn't face plant exactly. He did mumble some big lines. He mangled word order and invented some new words.

    But here’s the point: The big problem with the President’s State of the Union addresses not how he said it, it’s what he said. The President went through a litany of liberal concerns. He made a seemingly endless number of liberal promises, and he offered enthusiastic, unabashed, unrestrained support for abortion and the culture of death.

    Again, the big problem is not how the president said it. The big problem is what he said.

    Carol Platt Liebau: Selective Prosecution

    Chief among Americans’ complaints against President Biden’s Justice Department has been selective prosecution. It seems those on the right are prosecuted for conduct the left engages in with impunity.

    One federal judge in California agreed. He’s thrown out charges against right wing rioters on the grounds of selective prosecution.

    The rioters attended a pro-Trump free-speech rally in 2017. Leftist rioters, who attend such events to fight the right-wing groups, came primed for violence and attacked Trump supporters and police.

    The Biden Justice Department charged them under the Anti-Riot Act. Subsequently, the district court judge dismissed charges based on selective prosecution. He noted that the leftist groups instigated much of the violence and by many accounts behaved worse than the right-wing groups.  

    But the Biden Justice Department has appealed. It seems their old habits die hard.

    One thing is clear. It’s time for equal justice in America again.

    Hugh Hewitt: Our Border: A National Security Issue of the First Order

    President Trump had the border under control by the end of his first term and Trump has promised to do so again, quickly, in his second term.

    President Biden, in the sharpest contrast of the campaign ahead, lost control of that border by simply abandoning the Trump policy. More than nine million people have entered the country without permission in his first three years.

    That number, of course, does not include so-called “got-aways”—the illegal immigrants who never “encountered” law enforcement.

    Add to this the deaths from fentanyl streaming over our border with the illegal immigrants and organized crime, and we see all too clearly:

    The border is a mess.

    And it gets worse: Only 450 Chinese nationals were “encountered” at the border in 2021. By 2023, that number swelled to, wait for it, over 24,000. Estimates are that another 19,000 Chinese nationals have already entered in 2024 and the surge in this demographic is increasing. The vast majority of these Chinese people are military-aged, single males.

    We’re looking at a national security issue of the first order.

    We need to get serious now.

    Carol Platt Liebau: A Message of Unanimity

    In a victory for former President Donald Trump, the Supreme Court has rejected Colorado’s effort to keep him off its ballot this November. In doing so, the Court rejected a novel legal theory that would have allowed individual states to disqualify candidates for federal office.

    What’s striking is that the unsigned opinion was unanimous. Every single Supreme Court justice agreed with the central holding—that Colorado’s Supreme Court had erred in barring Trump from appearing on the ballot.

    The importance of this unanimity can’t be overstated. It signals that Colorado’s legal theory was a fringe one, and in doing so, it deters similar efforts in the future.

    A divided court, with dissenting opinions upholding the Colorado effort, would have had the metaphorical effect of injecting poison into our body politic. Kudos to the Supreme Court for uniting to protect the stability of our American electoral system.

    Ed Morrissey: Unanimous Supreme Court Upholds Actual Democracy

    The Supreme Court took a principled—and unified stand against interference with democracy. In a 9-0 per curiam decision, the court ruled that the people get to choose their candidates for president, not state judiciaries, prosecutors, or bureaucrats.

    Colorado had disqualified Donald Trump under the 14th Amendment by declaring him an insurrectionist. The unanimous court struck down that effort, rebuking their usurpation of Congress’ authority. “States have no power under the Constitution to enforce Section 3 with respect to federal offices, especially the Presidency,” they ruled. In fact, as the court pointed out, the 14th Amendment exists to limit state authority, not to expand it to deny voters their choice of candidates for federal office.

    In short, the Supreme Court defended actual democracy and the norms of the republic. The effort to deny Trump access to the ballot despite the support of his party’s voters was the real attack on democracy, an attempt to set up the judiciary as a star chamber inserted into the electoral process.
