After the initial frustration and disappointment and heartbreak of receiving a disqualification certainly after spending 15 or 20 hours processing at the NYPD Candidate Assessment Division candidate’s first question is: Should I appeal?

This podcast discusses some of the answers to that question. Certainly it will not get any worse if you appeal because you arer currently disqualified. Your appeal could get reversed and NYPD disqualifications are getting reverse with increased frequency at second interviews at Lekrak City Plaza or the NYPD Candidate Assessment Division located at 235 E. 20th St.

By not appealing your NYPD disqualification would become permanent. The withdrawal option has a limited value insofar as if your true goal is to be an NYPD Police Officer they will take out that disqualification file that you did not appeal and hold that against you and actually accuse you of consenting to the disqualification because you didn't fight back and appeal when you got your first one.

I have been assisting NYPD Psychological Disqualification candidates for 19 years. What I see is candidates with compelling arguments that their disqualification was unjustified are being restored to the eligible list for NYPD Police Officer.

I would be glad to discuss your NYPD disqualification with you during a free consultation.

If you receive an NYPD NOPD for psychological disqualification listen to the process and the steps necessary to appeal and get the disqualification reversed.

Law Office of Kevin P. Sheerin has been representing disqualified candidates for 17 years.  Lately disqualified candidates have an increased chance of success due to second interviews granted by NYPD.  To succeed at a second interview it is best to prepare in person with a seasoned attorney familiar with this process.

When you apply for NYPD Police Officer or School Safety Agent or NYPD Traffic Enforcement Agent you will be asked to sign a form giving NYPD Psychological Services Section permission to send you communications by email.

If you miss a Notice of Proposed Disqualification (NOPD) or Notice of Disqualification (NOD) and thirty (30) days passes you will not be able to appeal and you would have to take the exam again.

Discussion of Resignation issues in New York State civil service jobs.

After resigning employees may file suit to be reinstated.  These employees may claim that they were coerced or improperly threathened to resign and that they should be reinstated.

Also the resignation statute in New York states employees "MAY" be reinstated within one year.  "May" means just that-the hiring agency or employer has discretion to allow the employee to return.
