Kat joined Lamb McErlane from the United States Attorney’s Office for the Eastern District of Pennsylvania, where she served as Chief of the Criminal Division. She most recently served in the National Security and Cybercrimes Unit. 

Kat formerly was the District Attorney of Delaware County. Kat has held leadership roles at the state and federal level and was an instructor for the Delaware County Police Academy, the Pennsylvania State Police, and the Bureau of Alcohol, Tobacco, Firearms and Explosives. She became the first woman to lead the Delaware County Drug Task Force and has received numerous awards from local and federal law enforcement agencies. Police roadside searches of vehicles just became more difficult for law enforcement in Pennsylvania. On December 22, 2020, the Pennsylvania Supreme Court handed proponents of individual privacy rights a major victory when it narrowed the right of law enforcement to conduct roadside searches of automobiles in Pennsylvania. In Commonwealth v. Alexander, the Court held that warrantless vehicle searches require BOTH probable cause and exigent circumstances and that law enforcement may no longer rely on the inherent mobility of a vehicle (recognized under federal law) as an exigent circumstance to permit warrantless searches based on probable cause. Now, where law enforcement only has probable cause to search a roadside vehicle, and no exigent circumstances are present, a search warrant must be secured. Driving Under the Influence (DUI) & Accelerated Rehabilitated Disposition (ARD) 

ARD is diversion program for DUI’s after the preliminary hearing. 

If you are facing a first-time DUI charge in Pennsylvania, you may be eligible for a program called Accelerated Rehabilitative Disposition or ARD. It will allow you to resolve your PA driving under the influence case without a criminal record.

The District Attorney of each County determines who is allowed into ARD programs.  Most non-violent offenses are allowed into the ARD program.

In this podcast Lamb McErlane PC partners Jim Sargent and Guy Donatelli discuss a post-pandemic world, and specifically, about how basic concepts of employment already have changed and may change in the future.

For some, in jobs that require hands on skilled work––carpenters, plumbers, mechanics, people in retail sales or in cleaning and maintenance work, and all manners of healthcare––employment really has not changed (although perhaps interrupted, and although subject to social distancing and other safety measures.)

But for traditional office jobs, service work, in banking, accounting, tax, etc., remote work / working at home, has been the norm and may continue over the next six months, or permanently.

For office workers, in particularly, there may be new standards for performance and accountability––it may be a lot easier to track productivity via keystrokes on a remote computer, or when employee conferences via Zoom can be easily monitored by the boss...Tune in to hear more....

·       Mediation is confidential and provides the parties with a private way to resolve disputes.

·       Mediation also is without prejudice; no admissions; no testimony about proceedings.

·       Mediation is a collaborative process as opposed to an adversarial process, such as litigation or arbitration.

·       Mediation allows assistance of an acceptable, trusted, impartial third party who works to assist the disputing parties to reach a mutually acceptable settlement of their differences

·       Mediation does not end with someone making the decision for you.

·       It’s not like arbitration––where the arbitrators (usually 1 or 3)––hear the dispute and then tell you how the dispute is resolved.

·       It is not like going to trial where the Judge or jury tells you how the dispute is resolved.

·       In mediation you and your adversary––the person with whom you have the dispute––have to come up with the solution that you both can accept.

·       If no agreement at the end of mediation then you go back to court.
