So haben wir diese Woche erfahren, dass Trump dem Rat seines betrunkenen Anwalts lieber gefolgt ist als den Ratschlägen seines restlichen „inner circles“. Dass er die große Lüge vom Wahlbetrug genutzt hat, um Millionen von Dollar an Spenden für Anwaltskosten einzusammeln, die aber nie dafür benutzt wurden. Und, dass Vizepräsident Mike Pence im Kapitol kurzzeitig nur 12 Meter von dem wütenden Mob entfernt war, der „Hängt Mike Pence!“skandierte. Aber, haben diese Erkenntnisse irgendwelche Auswirkungen auf die loyalen Trump-Fans? Sehen sie die Ereignisse dieses Tages und ihren Ex-Präsidenten nun anders?     „Heute Abend sage ich dies zu meinen republikanischen Kollegen, die das Unhaltbare verteidigen: Es wird ein Tag kommen, an dem Donald Trump weg ist, aber Ihre Schande wird bleiben!“ Mit diesen mahnenden Worten leitete die Co-Vorsitzende des Untersuchungsausschusses zum 6. Januar die Präsentation dessen ein, was sie und ihre Kollegen in monatelanger Arbeit über jenen dramatischen Tag im Herzen der US-Hauptstadt zusammengetragen haben. Es geht um die politische Aufarbeitung dieses Tages. Zu bester Sendezeit, auf den meisten großen TV-Sendern landesweit, in teilweise ganz neuen Facetten.  

    Demzufolge geben die Abgeordneten eindeutig dem ehemaligen Präsidenten die Schuld für den Angriff auf das Kapitol. Anhand von Interviews mit Trumps Familienmitgliedern und seinem inneren Kreis, mit Hilfe von nie zuvor gesehenen Aufnahmen der Demonstranten, die die Kongresshallen stürmen, sowie Live-Aussagen von Augenzeugen, will das Komitee diesen Vorwurf beweisen. Trump habe die Gewalt provoziert, vor allem durch das Verbreiten der Lüge, dass die Präsidentschaftswahl 2020 „gestohlen“ worden sei. Er habe dann nicht nur dabei die Ratschläge seiner Berater ignoriert, sondern auch versäumt, die sich entfesselnde Gewalt auf dem Kapitolshügel effektiv einzudämmen. Doch wie nimmt die amerikanische Öffentlichkeit diese Berichte auf? Und zudem: Wird das Trump-Wähler wie unsere Väter beeinflussen?

    Rudy, Rudy Rudy….I’ve yet to quote the bible in this series, but to quote the King James version 2 Samuel Chapter 1 - “Oh how the mighty have fallen.” Rudolph William Louis Giuliani, once America’s hero, America’s Mayor, has become a laughingstock of the news, a punchline for late night hosts and pundits and possibly the most pathetic of all the Trump Mafia crew members. On paper, this guy was as good as it gets, I mean a real fucking stud of the judicial system. He served as US Associate Attorney General from 81-93 and US Attorney for the Southern District of NY from 83’ to 89’ and in 94’ he became the 107th Mayor of NYC. Seriously. A Fucking Rockstar. In the 80s, as the U.S. Attorney for the Southern District of New York he led the federal prosecution of New York City mafia bosses. He turned Times Square from a drug and porn epicenter in NYC into a veritable Disneyland filled with corporate restaurants, and businesses and made it into one of the biggest tourist attractions in the country. Rudy Gazooty was also widely credited with the steeply falling crime rates in NY, well ahead of the national average. In 2001, he was named Time Magazine’s Man of the Year, and if that’s not enough, in 2002, he was given an honorary knighthood by the Queen of Goddam England. I mean COME ON! So how did this “G” fuck it all up? Well, that’s the story I want to tell. You see, although he received those accolades, behind-the-scenes our headline-grabbing crime fighter, was not all pure of heart and most of his greatest hits, had a dark lining, which I will dig into, and when you understand the “REAL RUDY”—the Rudy who was married to his OWN FUCKING COUSIN FOR 14 YEARS—gimme a minute, I will explain this one—you will see that there has been no real fall from grace, he’s always been a douche bag.

    Die fast letzte Phase des Präsidentschaftswahlprozesses ist nun abgeschlossen. Die Wahlleute des Electoral College traten in allen 50 Bundesstaaten und der Hauptstadt Washington DC zusammen, mancherorts nur virtuell, und bestätigten unbehelligt die 306 Wahlstimmen für Joe Biden - und somit die Präsidentschaft. Das letzte verbleibende Hürde ist nun die Bestätigung des Kongresses am 6. Januar. Was kann bis dahin noch passieren?

     Gleichzeitig wurden die ersten Corona-Impfstoffe in den USA verabreicht - an einem Tag, an dem die Zahl der Todesopfer im Zusammenhang mit Corona 300.000 erreichte. Währenddessen twitterte Trump, dass er sich noch nicht impfen lassen und erst abwarten werde. Möglicherweise hat das auch mit den jüngsten Umfragen zu tun – demnach planen nur 40% der Amerikanerinnen und Amerikaner, sich impfen zu lassen. Wie effektiv kann ein Impfstoff sein, wenn das Vertrauen fehlt? Aber geht es hier um Gesundheit oder Politik, wie schon bei den Masken?

    So langsam kommt Schwung in den Übergang. Nach wochenlanger Hängepartie erhalten der designierte Präsident Joe Biden und sein Team endlich Zugang zu all den für den Machtwechsel notwendigen Informationen und Einrichtungen. Aber auch, wenn Präsident Donald Trump das nun zulässt, so hält er weiterhin daran fest, die Wahl nur durch Betrug verloren zu haben. Entsprechend lässt er seine Anwälte nach wie vor alle rechtlichen Schritte prüfen, um das Ergebnis anfechten zu können.
    Davon unbeirrt stellt Biden sein Team auf, benennt Schlüsselpositionen seines Kabinetts und bereitet sich nicht nur auf die Opposition der Republikaner vor, sondern auch auf die innerhalb seiner eigenen Partei. Denn die Spaltung der Demokraten in den eher moderaten Flügel (Biden) und den eher progressiven (z.B. Bernie Sanders, Elizabeth Warren) könnte sich als eine nicht minder schwierige Herausforderung für den künftigen Präsidenten herausstellen.

    Und zuletzt blicken wir auch noch mal auf die Wahlwerbe-Spots dieses vergangenen Wahlkampfes - welche waren die kreativsten, welche die fiesesten und welche die bewegendsten?

    QUESTION PRESENTED:

    A noncitizen may not apply for relief from deportation, including asylum and cancellation of removal, if he has been convicted of a disqualifying offense listed in the Immigration and Nationality Act. The categorical approach (including its "modified" variant) governs the analysis of potentially disqualifying convictions. Under that approach, a conviction for a state offense does not carry immigration consequences unless it "necessarily" establishes all elements of the potentially corresponding federal offense. Moncrieffe v. Holder,569 U.S. 184, 190-91 (2013).

    Accordingly, four courts of appeals hold that a state conviction does not bar relief from removal if the state-court record is merely ambiguous as to whether the conviction involved the elements of the corresponding federal offense. In their view, ambiguity means the conviction does not "necessarily" establish the elements of the federal offense. Four other courts of appeals-including the Eighth Circuit below-take the opposite view. They hold that a merely ambiguous conviction is nonetheless disqualifying because the immigration laws place an evidentiary burden of proof on noncitizens to establish eligibility for relief.

    The question presented is:

    1. Whether a criminal conviction bars a noncitizen from applying for relief from removal when the record of conviction is merely ambiguous as to whether it corresponds to an offense listed in the Immigration and Nationality Act.
