Appeals panel questions why 'presidential immunity' argument wasn't pursued years ago in Trump case

Story by By LARRY NEUMEISTER, Associated Press

    10-23-2023

NEW YORK (AP) — A federal appeals panel wants to know why lawyers for former President Donald Trump didn’t try years ago to use a claim of absolute presidential immunity to shield him from a defamation lawsuit by a woman who accused him of sexual assault.

A three-judge panel of the 2nd U.S. Circuit Court of Appeals in Manhattan listened Monday as a lawyer for Trump argued that a lower-court judge was wrong to reject the defense after it was raised three years after columnist E. Jean Carroll first sued Trump....

Judge Lawrence Silberman - A Tribute ( Bonus Edition) United States Circuit Judge for the Federal District Court of Appeals in the District of Columbia Circuit

Judge Lawrence Silberman - A Tribute ( Bonus Edition) United States Circuit Judge for the Federal District Court of Appeals in the District of Columbia Circuit

In this special edition we look back at a giant of the American Justice System. Laurence Silberman is a man most people, including me, had probably never heard of unless you were knowledgeable about the law.  I was introduced to him because he was on a panel examining the massive evidence of prosecutorial misconduct that the 2013 Freedom of Information Act lawsuit by Geoff Shepard had uncovered.  It was a symposium on the papers of Watergate hosted by The Federalist Society.

That Symposium will be featured on our podcast all next week. The legal experts that are participating in that symposium are impressive to say the least.  we are honored that The Federalist Society has granted our show permission to share the event with you.

Sadly, just over two weeks after the symposium Judge Silberman passed away at age 86. The suddenness of his passing had me curious to learn more about him, when I did ,  I realized that this man was an impressive one.

In this episode, we will hear from Judge Laurence Silberman on a range of topics including, his role in protecting the second amendment in a ruling that struck down the Washington D.C.  gun policy, his thoughts on free speech in this modern age, the Rowe v Wade decision, His thoughts on the court system, the number of lawyers in the United States, and his role as a co-chair on the special committee that looked into the second Gulf War and how we got involved in it.

This is one fascinating episode about  one of the most fascinating individuals in modern American History and a man that almost no one in the general public has even heard of,  until now.

It is a tribute to a giant.

    Judicial Accountability

    Judicial Accountability
The leaked Dobbs opinion, news on misconduct in judicial chambers with clerks and other employees, and emerging information about Clarence Thomas and Ginny Thomas have brought the lack accountability of judges to the forefront. In this episode Brandon Hasbrouck, Associate Professor at Washington and Lee University School of Law, and Aliza Shatzman will discuss legislative efforts to reform the judiciary, and what is required for real change.

The Norwegian Lundehund is a hunting dog. This dog has a collection of characteristics that makes him unique. He has at least six toes on each paw, to make it easier to hold onto slippery rocks. He can close off his ear canal to protect his inner ear from dirt and moisture. His neck is jointed so he can bend his head backwards and touch his forehead to his back. And his shoulders are jointed in such a way he can splay his legs straight out to the sides. All these traits make him a terrific hunter on cliffs, slippery rocks and in difficult passageways.

Lanhee Chen: After Mueller: A Look at the 2020 Election

Lanhee Chen: After Mueller: A Look at the 2020 Election

President Trump faces a much clearer pathway to reelection in 2020 now that Special Counsel Robert Mueller’s found no evidence that the President or the Trump campaign colluded with Russian efforts to influence the 2016 presidential election.

President Trump’s task ahead is to focus his reelection effort on the reasons why voters should give him a second term in office.  And while Democrats continue to obsess over Trump and his alleged misdeeds, it’s up to the President and his team to focus instead on the ways in which they’ve improved the livelihoods of the American people with tangible policy accomplishments.

The President spearheaded tax cuts that have helped many Americans keep more of their hard-earned money; his Administration has cut regulatory burdens and red tape to spur economic growth; and he has appointed judges to federal courts who respect the rule of law and the Constitution.

If President Trump can keep his rhetoric—and his focus—on touting these accomplishments, he’ll go a long way toward winning four more years in the Oval Office.

Lanhee Chen: Seeing the Similarities in the Early Entries for 2020 Presidential Contest

Lanhee Chen: Seeing the Similarities in the Early Entries for 2020 Presidential Contest

There are a whole lot of Democrats running for the presidency in 2020.  If names like Elizabeth Warren, Kamala Harris, Kirsten Gillibrand, and Joaquin Castro aren’t household names today, they certainly will over the next year or so.

While these candidates will try to sound different from one another, here’s what we know. They actually have a whole lot in common.

Each of them is in favor of higher taxes. Each is in favor of some form of single-payer health care. Each wants to impose more government regulation and red tape on small businesses. And each would appoint liberal judges to the federal courts.

These are not policies that will promote American prosperity and improve our lives. So even as they try to differentiate themselves from one another, know that it’s their similarities that are worth paying attention to.

Hugh Hewitt: It’s Time for the GOP to Push Some Nominees

Hugh Hewitt: It’s Time for the GOP to Push Some Nominees

The United States Senate returns to work this week and it’s time to talk about President Trump’s nominations again—especially those to the federal courts.

With the recent death of “Liberal Lion” Judge Stephen Reinhardt, the U.S. Court of Appeals for 9th Circuit has eight vacancies, but only two nominees. There are more than 150 vacancies across the federal courts as the White House nomination process, the Senate Judiciary Committee and Senate Democrats as a group have all worked at a snail’s pace.

Where are the nominees? It would take a week to fill out the list and send the names forward—if there was resolve and a sense of urgency.

It’s time for Senate Republicans to work as hard as ordinary Americans, especially when deadlines draw close. It’s time to act as though governing really is as important as senators campaigning for election say it is.

    Let’s see some nominees.
