    S2, E8: Legal aid, bureaucratic obstacles, and grassroots NGOs

    In this episode, Jasmin Arciero and Oliver Nixon  interview Alexa Netty, the trustee and chair of the steering committee of SolidariTee. SolidariTee is a charity that supports NGOs offering legal aid to forcibly displaced people​, and so they begin with a discussion on the importance of legal ​aid as a key facet of refugee support. They also touch on debates surrounding the role of NGOs in refugee crises: where they fit within a complex system of assistance and whether and how it is possible to overcome structural constraints on their coordination and efficiency. Alexa also shares personal stories from her time volunteering in refugee camps to shed light on some of the lived experiences of refugees and the obstacles they are forced to overcome to receive asylum. To conclude, Jasmin and Oliver discuss the future of SolidariTee and other issues that SolidariTee is working to address.

    Jasmin and Oliver are both studying for an MSc in Development Studies at the LSE. Having become engaged in the issues surrounding forced migration and displacement, they were intrigued to delve deeper into the debates surrounding humanitarian assistance and NGOs in support of forcibly displaced people. Jasmin, during her undergraduate degree, volunteered with SolidariTee (https://www.solidaritee.org.uk/), raising funds that contributed to legal aid grants, as well as leading awareness-raising events and sponsorships.

    Evictions and Access to Justice with Douglas Kwan & Nav Persaud

    In 2020, the Ontario Landlord and Tenant Board switched from in-person to online-only hearings. This has had grave consequences for tenants, many of whom do not have access to the necessary technology, resources or privacy to participate meaningfully – or sometimes participate at all – in remote hearings. In this episode, Nav Persaud (MAP scientist and Canada Research Chair in Health Justice) speaks with Douglas Kwan (Director of Advocacy and Legal Services at Advocacy Centre for Tenants Ontario) about the impact that this change has had on tenants' lives and abilities to access eviction prevention services. Expansion of access to eviction prevention interventions, including access to legal services, is a recommendation in MAP's Equity Roadmap Report.

    Chris and Alison sit down to speak with Gordon Bonnyman, co-founder of the Tennessee Justice Center.  Mr. Bonnyman has practiced poverty law for 48 years.  His work has spanned so many areas of the law we could not begin to cover them all - he's litigated nursing home regulations, prison conditions, hospital pricing abuses, confinement of children with disabilities, due process for Medicaid recipients, and many others.  He has lectured and consulted on health law and policy and testified at congressional hearings on health and civil rights.  He discussed his work and the importance of storytelling with us.

    Bill 161 - Ontario's 'Smarter and Stronger Justice Act'

    When it comes to access for justice in Ontario, it appears the province’s Bill 161, the Smarter and Stronger Justice Act, will do neither.

    While the province continues to grapple with the pandemic, predominantly in long term care homes, Bill 161 will support defendants being sued. There are several class action lawsuits currently underway against operators of some of these facilities for negligence. The pandemic has hit low income Canadians hard - and these are the people who use Legal Aid Ontario to access justice. The new language in the Act puts cost ahead of justice when it comes to Ontario’s most vulnerable.

    On this edition of the Unpublished Cafe, we’ll find out more about the impact of the Smarter and Stronger Justice Act on legal aid as well as what it means for class action lawsuits.

    This lecture examines the celebrated 1971 English case of McKenzie v McKenzie, in which the Court of Appeal unanimously affirmed the important principle that any person conducting proceedings in court is entitled to quiet assistance from a person of their choice. 2019 marks fifty years since the initial divorce trial of McKenzie v McKenzie in London.  The lecture is presented by Ian Hanger AM QC, who was the original ‘McKenzie’s friend’.
