    SLAPP Fighting

    Anti Libel Chill legislation is a fairly recent change. Libel Chill is the fear of being sued for speaking your mind. 

     

    An example of this is if a developer wanted to build something in a particular area but a grassroots ratepayer organization formed to oppose it. The developer might hire a legal team to essentially send the message that if people say bad things about the developer say on social media, there will be litigation. 

     

    You want to say bad things about me, I’m going to make it expensive for you.

     

    This kind of strategy has become common, and a name has developed called Strategic Lawsuits Against Public Participation or SLAPP. Now a number of Canadian jurisdictions are putting in place Anti SLAPP legislation with a goal to give people peace of mind when they speak their mind.

    Could lawsuits meant to curb disinformation hurt press freedom?

    Libel laws and the First Amendment in the United States are meant to hit a sweet spot — protecting reputations and facts while also affording journalists the freedom to publish unflattering information about powerful people that the public needs to know. But disinformation is increasingly threatening that balance.

    In this episode, law professor RonNell Andersen Jones explains what could be at risk. “If it's too easy for somebody to sue for defamation over a falsehood, then powerful people will hold that over everybody's head and threaten to sue their critics and will silence a lot of conversation that we ought to be having," she said.

    Jones is a Distinguished Professor and Teitelbaum Chair in Law at the University of Utah and an Affiliated Fellow at Yale Law School's Information Society Project. A former newspaper reporter and editor, Jones is a First Amendment scholar who now teaches, researches and writes on legal issues affecting the press and on the intersection between media and the courts.

    On the 1st of June, Johnny Depp won his defamation trial against Amber Heard. 

    It was televised live and social media consumed and commented on it like a spectator sport or reality tv. While some people watched the entirety of the trial, many others kept up by watching bits and pieces circulating on social media in the form of memes. The entire thing was bizarre, to say the least. Netizens cheered and clapped for Johnny Depp and poked fun at Amber Heard. 

    But has there been a disinformation campaign surrounding the trial? And does Johnny Depp deserve his heroic redemption arc?
