In a recent development, Judge Casey Rodgers, overseeing the 3M Earplugs MDL, has taken action. She appointed Randi S. Ellis as the special master to oversee the negotiations, setting a minimum of three days for mediation.
The goal is to reach a settlement and relieve the federal court system from the immense burden presented by the earplugs cases. Currently, there are approximately 233,000 cases in the MDL (down from the peak of 282,902), which will soon be returned to their respective districts for trial in groups of 500 lawsuits at a time. There are no guarantees, but with motivated parties and a determined federal judge, there's hope on the horizon.
