But after the face behind the white paint is finally revealed, hopes begin to falter that Marlene's murder would ever be truly solved.     Episode 3 / Motion to Dismiss

    In this episode, we explore other theories about who the killer clown might have been. And we'll hear from the Defense as they are entering a Motion to Dismiss.

    That motion hangs largely on what the Defense calls deceptions and delays, attempted "tactical advantages" from the state.

    Like how the state didn’t turn over evidence it had for years- that was located in, of all places, a box at the State Attorney’s Office. The box contained a folder called "Clown Sightings."

    Lawyers wrote in the motion to the court that evidence "mysteriously appeared five years after Ms. Keen-Warren's arrest and nine days before her [first scheduled] trial."

    The motion claims Keen-Warren needs the information from the file for a fair trial under the 1963 Brady v. Maryland case in which the Supreme Court ruled the prosecution must give the defense all evidence that might exonerate the defendant.

    The defense says the “file contains clown sightings and citizen leads from the day of Marlene Warren's murder...the State maintained it did not have the file for more than three years, and lead detective Paige McCann refused to look."

    The motion goes further, “the State did not dispute the requested information constituted Brady material but instead claimed without evidence it did not have the information and materials that the Defendant requested, even though the defense provided the court with transcripts from Detective McCann's depositions where she conceded that she did nothing to locate this file." (The word "nothing" was underlined in the motion.)

    “The State’s job is to ensure justice, not to secure a conviction. We’re interested in seeing what other evidence is out there, and we’re going to continue to fight for Ms. Keen-Warren’s freedom,” Attorney Greg Rosenfeld said.

    Two clerks from the costume shop where prosecutors believe Sheila Keen-Warren bought a jumpsuit, wig, and makeup, testify about their interactions with an odd-ball customer.

    This hearing is part of a marathon of arguments from the defense and prosecution to suppress evidence.

    The jury may not get to hear from the two sales-women, that's up the judge to decide before this trial starts in May.

    The defense says the clown get-up they sold was not what the killer was wearing, but on the question of who bought it, both the clerks picked Sheila Keen Warren out of a photo line-up and pointed to her in court.

    Dinah Rosales and Debra Lee Offord worked at The Spotlight Capezio. They told investigators, late one evening, May of 1990, a woman showed up after closing, they opened the door for her and let her in, she said she needed a clown outfit.

    They helped her pick one out.

    The mystery woman was described by both clerks as being , "not very feminine”, and that's potentially important because Keen-Warren is sometimes described by her familiars as being kind of a Tom-Boy.

    The customer was wearing a denim shirt, jeans and work boots, and she purchased a handful of items, then paid in cash and left, spending approximately 15 minutes in the shop.

    Rosales testified that the customer asked specifically if the face paint she was picking would cover up her whole face or should she buy two containers of it?

    The clown's wig is also an important detail and much this episode explores it.

    Many people from South Florida have heard this one before, but it's not a joke. Quite the opposite.

    A murder trial more than 30 years in the making is about to start.

    The defendant is accused of First Degree Murder with a Firearm. Prosecutors say she dressed in a clown costume, brought flowers and balloons to her lover's wife, then shot her at point blank range.

    There would be no arrest for 27 years but it eventually happened more than 800 miles away.

    This case started on Memorial Day weekend, 1990, in Wellington.

    The first George Bush was president. Germany was reunified. The Hubble Space Telescope was launched. And there was a new kind of car being built, called the Saturn.

    Marlene Warren was home on Saturday, May 26.

    The 40-year-old mother had money. She lived with her family on Take Off Place in the exclusive Aero Club community, where large houses with small hangars encircle a landing strip.

    There were others home at the time: her son and some of his friends. The doorbell rang. Marlene would answer it.

    On the other side was a clown. A killer clown.

    The flower arrangement and two balloons had been bought earlier that day at a Publix, about a mile away from the suspect's apartment. One balloon read, "You're the Greatest." Snow White appeared on the other. The cost of the flowers: $15.87. The buyer paid $100 in cash, according to court records.

    The clown offered the items to Marlene, who reached out to grab the balloons and said, "How nice."

    Then the clown pulled out a gun and shot Marlene in the face. She fell to the ground.

    Outside, the clown was last seen walking calmly to a white Chrysler LeBaron convertible.

    Bill Kramer was a neighbor who was walking his Labrador retriever. Years later and still living there, he told CBS12 News he heard the gunshot. His wife went out the back of their house and someone asked her to call 911 because somebody had been shot.

    Kramer and his neighbor who was a doctor ran to the home. The doctor asked him to help administer first aid before first responders arrived.

    Nobody could save her.

    9/27/2017: Neighbor relives day of the clown murder

    Marlene Warren would die in the hospital, two days later, on Memorial Day.

    The Palm Beach County Sheriff’s Office had a person of interest in the killing but wouldn’t say so for many years.

    Four days after the shooting, detectives recovered a white LeBaron and said it was the killer’s.

    The car had been rented, and Michael Warren owned a business called Bargain Motors.

    A detective said the people who rented the car mistakenly called to return the car early but were told to leave the car and keys there.

    Investigators said Michael Warren, a woman named Sheila Keen, and a third person picked up the car.

    Keen used to repossess cars for Warren, husband of the victim.

    She’d been separated from her husband for a few months and rumored to be having an affair with Michael Warren.

    In fact, Keen’s estranged husband told that to investigators.

    But Michael and Sheila repeatedly denied that allegation, and there was not enough evidence to charge Sheila, though detectives later said they had a lot of puzzle pieces in 1990, and had Keen on their radar not long after the murder.

    Still, the crime went unsolved. It seemed nobody would pay for the murder of Marlene Warren.

    Then, time passed. A lot had changed after nearly a quarter-century.

    In 2014, the sheriff's office received new grant money. Its cold case team took a new look at the old crime.

    Investigators reconnected with witnesses.

    They used technology not available in 1990 and conducted additional DNA analysis.

    Then, there was a break in the case. Authorities thought they’d unmasked the killer clown.

    In August, 2017, prosecutors took the case to a grand jury, and Sheila Keen was indicted for first-degree murder.

    But she wasn’t exactly Sheila Keen and she didn’t live in Florida anymore.

    In 2002, she married widower Michael Warren and moved to a different world: the Tri-Cities of Tennessee and Virginia.

    There’s a joke that it’s not the Bible belt; it’s the buckle.

    The new Mr. and Mrs. Warren lived about 10 miles northeast on the Virginia side, in Abingdon.

    They ran a fast food restaurant called the Purple Cow across the state line in Tennessee.

    Sheila Keen-Warren’s arrest came years after living her new life, in the evening of Tuesday, Sept. 26, 2017.

    9/27/2017: Victim's parents react to clown murder arrest

    Authorities from Palm Beach County were there for the event.

    Washington County Sheriff Fred Newman said Michael Warren was present when his wife was arrested for the murder of his previous wife.

    Sheila Keen-Warren, then 54, was arraigned the next day and extradited a week later.

    She made her first court appearance the next day. No decision had been made about whether she’d face the death penalty for the crime.

    First, the prosecution wanted capital punishment. Then, they decided against it.

    The state shared evidence with the defense team, but the state didn't share all of its evidence with the defense team.

    And there are issues over the quality of the DNA evidence, and whether it was contaminated.

    That has caused delay after delay after delay in the State of Florida v. Sheila Keen-Warren, year after year after year.

    The only things one can be certain of won't change anytime soon is that Michael Warren's first wife is dead, and his second wife will be spending another night in jail waiting to be tried for her murder.

    Davis bashed his mother's head in with a hammer

    Summary: Corpus Christi resident Kevin Davis strangled his mother before hitting her in the head with a hammer, splitting her skull. Davis then ‘swirled’ her brain around before sexually assaulting her corpse. Davis was sentenced to life in prison for the crime of a mom who he described as “The best.”

    In 2014, Kevin Jazrael Davis argued with his mother, 50-year-old Kimberly Hill, in the Corpus Christi, TX, apartment he shared with her and his sister, Destinee. On May 26, Davis called 911, reporting that he’d just murdered his mother. Once at the police station, then 18-year-old Davis vividly detailed the day’s events, sometimes with a smirk on his face. What he told detectives was gruesome and shocking: Kevin admitted bashing \Hill’s head with a hammer, swirling her brain around, and then, sexually assaulting her corpse.




    "I'll Kill My Mom Instead"


    On the morning of March 27, 2014, Davis, bored and frustrated with life, told his mother he did not like people and that he wanted to commit suicide. Obviously caught off guard by the statement, Hill allegedly told her son that she could not stop him if that was what he wanted to do. Kevin later told police hearing this from his mother enraged him. It was then he decided to take her life.




    As Hill sat on the couch in the living room, Davis came up behind her, attempting to strangle her with a cord. Hill began screaming. Kevin panicked, retrieved a hammer, and began bashing in his mother’s skull. Davis struck his mother in the head with the hammer at least 20 times, splitting her skull in the process.




    Davis then retrieved a kitchen knife and used it to insert inside his mother’s head wound. He swirled her brain around “to make sure she was dead,” Kevin claimed and then inserted his hand inside the wound. He would tell detectives during a taped interrogation that his mother’s brain felt like “putty.”




    Kevin then dragged his mother’s lifeless body to her bedroom and raped her corpse. When he finished the sadistic act, he went to a neighbor’s house, saying he just killed someone and needed help. The neighbor dialed 911.

    National UFO Reporting Center - Information and Policies

    The National UFO Reporting Center was founded in 1974 by noted UFO investigator Robert J. Gribble. The Center’s primary function over the past four decades has been to receive, record, and to the greatest degree possible, corroborate and document reports from individuals who have been witness to unusual, possibly UFO-related events. Throughout its history, the Center has processed over 150,000 reports, and has distributed its information to thousands of individuals.


    The principal means used by the Center to receive sighting reports is this website, which has operated continuously since 1994.  Prior to that period, the telephone hotline and the U.S. mail were the primary means of taking reports.  


    The Center’s independence from all other UFO related organizations, combined with its long standing policy of guaranteed anonymity to callers, has served to make it perhaps the most popular and widely accepted national UFO reporting facility anywhere.  The website and hotline are well known by law enforcement agencies, FAA ARTCC’s and flight service stations, National Weather Services offices, military facilities, NASA, and many 911 emergency dispatch centers all across the United States and in many parts of Canada.     Call #1 Solicitor's Office releases 911 call from castle shooting


    Allen Stephenson, the founder of Southern Tide, shot and killed Matthew Whitman, 32, last month on the grounds of Stephenson’s estate, which was built to look like a German castle. Stephenson said Whitman was hostile and armed with a knife.


    Stephenson said Whitman took a knife out of his pants and thrust it at him, at which point Stephenson shot Whitman five times, the solicitor's office said. 


    According to the solicitor's office, Stephenson fired seven shots: two warning shots from his porch, and five shots at Whitman from outside the home, three that struck him.


    Stephenson's girlfriend was on a call with 911 when the shots were fired. The shots can be heard in the call, according to officials. 


    The solicitor's office said the two men did not know each other. 


    The Solicitor's Office announced Tuesday that they wont prosecute Stephenson in connection with the shooting. 


    The statement by Whitman's family said; "The Whitman family is disappointed by the decision not to prosecute Allen Stephenson for the homicide death of our son, Matthew. We have waited patiently while this investigation has proceeded and have been provided small pieces of information along the way."


    "We look forward to seeing the entire investigation file now that the Solicitor’s Office claims the investigation is 'over' and the Solicitor’s and Sheriff’s Offices have promised to now release it."


    Whitman lived on Nature Trail Drive, about a mile and a half from the estate.

    A six-months-pregnant Ohio mother of two was shot to death in her family's home after her boyfriend decided he didn't want to father a child, the victim's dad said.


    Julia Young, 36, was found dead in her family's Medina home Monday by her mom and one of her sons. She had been killed by on-and-off boyfriend Cedric Jones, 43, who also killed himself.


    'He didn't want the baby,' her father, Philip Duke, told Cleveland.com. 'I don't know if this is his way of dealing with it. We'll never know.' 


    Call #3 Gwinnett teen suing CSX after train accident severed his legs


    Jacob Ohl lost both his legs below the knee when he was run over by a train in Lilburn in March. Four months after he was released from the intensive care unit, Ohl is suing CSX and the operators that were allegedly running the train that hit him.



    Ohl, 17, filed suit in DeKalb County last week. The lawsuit claims CSX and operators Derrick Tyrone Marshall, of Stone Mountain, and Clifton Edward Martin, of Greenwood, South Carolina, were negligent and that CSX was liable for his injuries, which have already racked up more than $200,000 in medical bills.

    Horrifying 911 Audio, Body Cam Footage Released After Fort Smith Woman Drowns During Flash Flooding

    Though it was a difficult decision, we have decided to broadcast and post the 911 call for help after concerns were raised as to how dispatchers and first responders handled the situation.


    FORT SMITH, Ark. (KFSM) — 911 audio recordings and body camera footage from Fort Smith police officers during their efforts to try and save a Fort Smith woman from last weekend's flash flooding have been released. The audio files released are those of a woman's last dying moments. On Monday (August 26) between dispatchers and first responders were released during their efforts to locate the woman.

    Debra Stevens died around 6 a.m. Saturday (August 24) on Kinkead Avenue while delivering papers.


    According to the Fort Smith Police Department, the 911 call came in at 4:38 a.m. First responders were dispatched at 4:40 a.m. The first crews on the scene arrived at 4:53 a.m., but were not close enough to reach Stevens' because of high water. According to Aric Mitchell with the Fort Smith Police Department Stevens’ first call was to a family member. However, as floodwaters continued to rise around her, she dialed 911 from her cell phone.


    Due to high waters, it took more than an hour from Stevens' 911 call for first responders to make direct contact with her. Mitchell says that Stevens was having trouble describing her exact location and flooding limited the ability for first responders to locate her. By the time they got to where her vehicle was, it was too late.


    Emergency crews tried to rescue Stevens but the water was too high and too fast. When first responders were finally able to pinpoint the location of Mrs. Stevens’ vehicle, the swift, rising water made immediate rescue impossible.


    In the recording, you can hear first responders trying to take multiple routes to rescue her.


    After Stevens vehicle became trapped in floodwaters, it floated into a creek at the end of the road. She was unable to escape and died as water filled her car.


    The Fort Smith Police Department is attempting to remain as transparent as possible in this tragedy and has released a timeline of events:


    The 911 dispatcher, Donna Reneau, can be heard telling Stevens "this will teach you next time don't drive in the water...how you didn't see it, you had to go right over it."


    Fort Smith Police Chief Danny Baker released the following statement about the events from Saturday (August 24) morning:


    “I am heartbroken for this tragic loss of life and my prayers are with Debra’s family and friends. All of our first responders who attempted to save Mrs. Stevens are distraught over the outcome. For every one of us, saving lives is at the very core of who we are and why we do what we do. When we are unsuccessful, it hurts.”


    Baker also addressed Reneau's actions, saying "the manner that she spoke during this conversation would have probably been addressed, but it would have been more a rudeness quality type service complaint. I don't think it would have risen to the level of terminating someone."


    Reneau, who is a certified dispatch trainer for new employees, put in her two weeks notice before this and that call came on her last day and final shift. She was named fire dispatcher of the year in February.


    "We can't investigate someone who no longer works here. However, an investigation into our policies, our responses, our dispatch center, I've talked to the fire chief, we are looking at what we can do to increase training for our dispatchers, swift water rescues and other things," Baker said.


    A memorial has been set up in remembrance for Stevens.


    The dispatcher that handled Stevens' call resigned two weeks ago and Saturday was her last shift, according to Fort Smith Interim Police Chief Danny Baker.

     Baltimore police released a body-worn camera video Tuesday from the officer who shot and killed a man who was threatening a woman with a knife Sunday.


    The video shows the officer, identified as Zachary Rutherford, pulling up to the scene in West Baltimore, where he sees Tyree Moorehead on top of a woman and holding a large butcher knife at her head.


    Rutherford screams "drop the knife" but Moorehead continues to straddle the woman on the pavement. Rutherford then fires his weapon multiple times at close range, the video shows.


    As Rutherford fires his weapons, the woman rolls away to safety. She was not shot or stabbed, police said.


    "We can see that it's clear that the officer saved this lady's life out there that day," Commissioner Michael Harrison said.

    A second video from another officer, Officer trainee Michael Hazel, shows officers rendering medical aid to Moorehead. He was taken to the University of Maryland's Shock Trauma Center, where he later died.


    Harrison said the attack on the woman appeared to be random. The woman said she was running errands when he was attacked by Moorehead around 3:30 p.m. Thursday in the 1800 block of Lafayette Avenue.


    When asked if the use of force was excessive, Harrison said that the investigation by both the department and the state's Attorney General Office would answer that question.


    The Baltimore City chapter of the NAACP said the group "believes that police intervention was necessary," but questioned whether excessive force was used.


    "Fourteen shots were discharged from the officer's weapon. Is that use of force justified or is that a case of excessive force?" the group asked.
