AI Inventor Appeal Dismissed, Raises Concerns on Trade Secrets

AI Inventor Appeal Dismissed, Raises Concerns on Trade Secrets
Good morning from OWITH.ai: the podcast that gives you only what's important to hear in the AI and tech world. In today's episode, we have some interesting news to share with you. Let's get started!## The UK Supreme Court has dismissed an appeal by the Artificial Inventor Project, a group seeking to obtain patents for inventions created by artificial intelligence (AI). The court ruled that AI is not a natural person and, therefore, cannot be considered an inventor. This decision has raised concerns about AI-generated inventions becoming trade secrets instead of being disclosed publicly, especially in the field of AI drug discovery. However, appeals are pending in several countries, and the project's chief hopes that lawmakers will extend protection to encourage the use of AI in research and development. In a separate development, a Japanese government panel has suggested that training AIs on copyright-protected works may constitute a copyright violation.## Ethereum's gains in 2023 have been overshadowed by Bitcoin's performance and the rise of Solana. One of the main challenges facing Ethereum is high gas fees, which make simple transactions unviable. While layer-2 solutions have made the blockchain more affordable, they also introduce complexity for casual crypto users. Ryan Selkis, founder of Messari, believes that Ethereum is losing some of its luster due to the availability of Ethereum substitutes and institutional interest in Bitcoin as digital gold. However, Selkis also acknowledges that competition in the smart contract industry was inevitable. Despite these challenges, Ethereum still holds the position of the second-most-important blockchain.## Figma's sale to Adobe fell through, and it is unlikely to find another buyer willing to pay $20 billion for the company. Adobe and Figma mutually called off the transaction due to a lack of regulatory approval. Figma provides creative collaboration software as an alternative to Adobe's offerings and has grown significantly since September 2022. While some speculate that Figma could go public in the future, finding another buyer willing to pay near $20 billion is unlikely. Adobe now has $10 billion in cash that it could potentially use for stock buybacks.## The 2023 Stratechery Year in Review reflects on the past year and highlights the most popular and important posts on Stratechery. Two major topics dominated the year: AI and the evolving content landscape. The review provides insights into the impact of AI on existing companies, the strategies of big tech companies, and its potential to reshape industries like Hollywood. The evolving content landscape was another key theme, with discussions on Netflix's strategy, the shift towards a unified content business model, and the challenges faced by traditional media companies. Regulation and its implications for technology companies were also important topics in 2023.## Incorporating ESG metrics into CEO pay plans is becoming more common among S&P 500 companies. A new report from the Conference Board reveals that 54% of these companies now include climate metrics in their CEO pay plans, up from 25% in 2021. Diversity and inclusion metrics have also increased, with 75% of S&P 500 companies including them in their pay plans. Large companies are more likely to report the use of ESG metrics in their pay packages. The report concludes that the ESG backlash has not deterred companies from integrating ESG-related performance metrics into their incentive plans for CEOs and senior executives.## OpenAI's GPT-4 performed better than GPT-3.5 but still struggled to distinguish between AI and human responses in a recent Turing test. While GPT-4 scored higher than its predecessor, it only correctly identified humans in 63% of inte

Protecting intellectual property in service-based businesses, with Erin Austin

Intellectual property is a vital business asset that needs protection. It includes all your ideas, creations, products/services that drive growth.

If you don't protect your intellectual property (IP), you risk competitors stealing or copying what you do, which could lead to lost revenue.

The digital age has further complicated matters. It is now very easy to accidentally copy someone else's work, thanks to the rise of AI and automation that continue to blur the lines between innovation and imitation.

But what is intellectual property exactly?

Where do you start protecting what you own?

How do you know when to use a copyright, license or trademark?

And how can you use your intellectual "assets" to increase your sales and achieve business success?

In this episode, our guest Erin Austin breaks down all aspects of intellectual property, its different categories, how to use them and how to start protecting your creations. She also shares tips and insights on using your IP assets to help propel your business forward.

    We discuss:

03:55 The difference between copyright, trademarks, trade secrets, and patents.

12:19 AI-generated content and copyright laws

14:04 Establishing the legal status of derivatives from your original copyrighted work

15:03 Identifying the rightful owner of copyright for AI-generated content

20:35 Exploring the distinction between "R" and "TM" in trademarks

22:56 Evaluating how long and what to consider when applying for copyrights/trademarks

27:47 Presenting individuals who leveraged IP to transform their businesses

31:05 Understanding the role of licensing, alongside copyrights, trademarks, and trade secrets

Ep. 23: How Recent Trade Agreements Are Regulating the Digital Economy with Matt Malone

Ep. 23: How Recent Trade Agreements Are Regulating the Digital Economy with Matt Malone

Canada is a trading nation.  Throughout our history, trade has been one of the foundations of our economy.  Equally important has been to establish rules for international trade.  This episode we hear how trade agreement commitments are shaping Canada’s ability to regulate the digital economy.  Matt Malone, Assistant Professor at the Faculty of Law at Thompson Rivers University, talks about how recent trade agreements are shaping the digital economy, often before domestic governments have acted with their own laws and regulations in pertinent areas.

He cautions that as Canada seeks to revamp law and policy for the digital economy, a growing risk area is divergence between our international obligations and our domestic laws and policies.  In particular, he notes trade secrets are the go-to intellectual property for algorithms, data, and secret processes and formulas, but Canada’s law, policy, and enforcement in this area are uncertain and weak, even as trade agreements impose requirements for stricter regulation and enforcement.  Ultimately, Matt calls on Canada to adopt a proactive approach that contemplates the impact of such provisions in trade agreements on its domestic law and policy goals.
