    About this Episode

    We begin with news items.

    • A FOIA has shown that the CDC expected 1,000 adverse reaction reports every day BEFORE the COVID VAX was released.
    • Kari Lake has won the right to show that Maricopa County violated Arizona law in a way that threw the election to Katie Hobbs.
    • The CHIPS Act was supposed to subsidize computer chip manufacturing in the US, but unions and others who have nothing to do with chip manufacturing are lining up for a pied of the $52 billion.

And the final act. New York Attorney General got elected with a promise to convict Donald Trump. Now it looks like his Grand Jury is ready to ride him out of town on a rail for prosecutorial misconduct.

Episode 79 - The Legal Beat Goes On

Episode 79 - The Legal Beat Goes On

The twists and turns of the Trump legal saga of Jack Smith continues. Trump may not win the immunity argument on this go-around due to procedural issues. But at the end, Trump should win on the merits. The Presidency must depend on immunity from suit for things done as part of the job.

Meese, Calabrese, and Lawson filed in the DC Court of Appeals a carbon copy of the Amicus brief SCOTUS never got to rule on when they kicked the case back to the DCCA. And that brief argues that Smith is not a legitimate prosecutor. His cases should be dismissed. Of course, everything he touched becomes Fruit of the Poisonous Tree. Both is prosecutions would be kicked to the curb, and all evidence is tainted.

Episode 78 - Jack Smith is not a Special Counsel

Episode 78 - Jack Smith is not a Special Counsel

Under the law, Jack Smith is a private citizen, not a Special Counsel. He didn't execute his acceptance of his commission timely or in proper form. And he was unlawfully appointed to an office that does not exist under law. Therefore, everything he has done is "fruit of the poisonous tree" and must be thrown out. That means that the J6 and Mar-a-Lago indictments are fatally flawed and of no legal merit.

Episode 77 - The Colorado Supreme Court Mangles the Constitution to Keep Trump Off the Ballot

The Colorado Supreme Court, overrun with Poison Ivy League law school graduates decided that Trump can't be on the primary ballot. What does the Constitution actually say?

Episode 76 - Legal News - The Good, the Bad, and the Confusing

Good news with Vote.org v Paxton where original signatures are OK on voter registrations.

Bad news with Tingley v Ferguson, where Washington state is allowed to continue draconian restrictions on doctors. Also, Austin Sarat demonstrates his utter disregard for intellectual diversity in his Justia opinion piece.

Confusing news in the Jack Smith January 6 case against Trump.

Episode 74 - Your Brain is a Story Processor

Episode 74 - Your Brain is a Story Processor

Our brains are story processors. Stories carry meaning, and we hear the stories that match our world view. Our minds are not logic processors. That's why Andrew Wilkow is unlikely to persuade people. Stories are what convince people of ideas.

The American Dream is a Story. It is told again and again in shows like 1883 and 1923, where lives are risked in the quest for a better life that the government will not steal from you.
