    Taking a Look at the NPRM for SMS

    As expected, the FAA released proposed rules (NPRM) about expanding Safety Management System (SMS) requirements to certain Part 121 certificate holders and others.  Host Jason Starke read the NPRM and shares his initial thoughts on the proposal. 

    The NPRM directly addresses SMS requirements for Part 135 air charter operations and companies holding a letter of authorization to conduct air tour operations (under Part 91.147).  

    Deadline for comment is March 13, 2023.

    There've been rumblings about SMS Regs coming to Part 135 operators.  Listen in to get accurate information of what's actually in the sections of 14 CFR 5 as applicable to "States." 

    NOTE: This episode was recorded just prior to the 2023 FAA Notice of Proposed Rulemaking (NPRM) (88 FR 1932), which directly addresses Safety Management System (SMS) requirements for “certain certificate holders and commercial air tour operators." As published on Jan. 11, 2023, the FAA proposed rule includes “commuter and on-demand operations, commercial air tour operators, production certificate (PC) holders that are holders or licensees of a type certificate (TC) for the same product, and holders of a TC who license out that TC for production."

    In this episode we discuss rather the focus on the organization's role is perhaps not as new of a concept as proponents are making it out to be. Has the correlation between individual responsibility and the responsibility of the system already been evident in organizations where leadership and safety culture are vibrant? Perhaps we don't need to go out and embrace a new movement, or an "awokeness" towards safety but keep our leadership and safety culture vibrant and healthy.
