Why Is Defining Consent So Difficult?

Why Is Defining Consent So Difficult?

Consent is a concept at the center of criminal law and sexual assault. So, why is it so difficult to accurately define? Sexual assault laws have evolved from requiring the victim to resist toward requiring consent. However, “consent” is defined in many ways.

In this episode, two experts on the topic, Criminal Law Professor Aya Gruber and AEquitas Co-Founder and CEO Jennifer Long, discuss and debate the potential for success and failure of implementing an “affirmative consent” requirement, how we now understand that there is no expected behavior during or after a sexual assault, and how important is to treat every case individually.

Is Affirmative Consent Insane? Maybe Not Entirely...

I want to explore my personal evolving views of what is going on in the aftermath of the #METOO movement, especially the notion of affirmative consent which has a lot of men left scratching their heads.

I've spent a lot of time talking to women trying to understand their take on the events and the general psychological environment of the movement and why it exploded so quickly and what it's fighting for.

I've learned some pretty incredible facts about women's' experiences around men especially when it comes to sex that I didn't know before and it has certainly given me more compassion than I had before, even though I think a lot of the execution leaves a lot to be desired.
