    James Griffin Falsely Accused, Imprisoned For 20 Years On A Crime He Did Not Commit AND Was THREE HOURS AWAY FROM THE SCENE OF THE CRIME, With Lauren Griffin And Kelly Patton

        Slam the Gavel welcomes James Griffin, Lauren Griffin and Kelly Patton who was last on the podcast Season 4, Episodes 124, 146, 151. James Griffin spoke from El Dorado Prison, Kansas along with his wife Lauren. James Griffin has been imprisoned for the last 20 years on a crime HE DID NOT COMMIT.  Police came to his home on January 15th, 2004 and arrested him and James didn't even know the restaurant or the area.  His charges were: attempted murder in the 2nd degree intentional, attempted aggravated robbery and conspiracy to commit aggravated robbery. Apparently, there was a robbery at a Topeka, Kansas restaurant (with no cameras), FOR THE THIRD TIME, where a person entered  wearing dark clothing and shot the owner. There was a vehicle waiting that was similar to a vehicle James owned, but witnesses couldn't identify the vehicle, the color of the vehicle or the driver. The prosecutor, Robert Hicks took the description of the shooter and focused on that with the witnesses and not the driver. However, James was three hours away visiting with his mother and this is verified by cell phone records. A man CAN'T BE IN TWO PLACES AT THE SAME TIME. But the witness's stated he sounded, "BLACK." One of the witnesses 10 years later, on March 15th, 2013, later recanted his statement.
         There was no DUE PROCESS, no VOICE ANALYSIS, NO CAMERAS, NO TIRE ANALYSIS and NO FORENSICS DONE ON ANYTHING. His attorney didn't let him speak AT ALL during trial. Mr. Michael McElhinney continuously repeated the phrase, "if a judge instructs you, though that I am in for a penny, in for a pound, can you follow that even if it goes against what you personally believe should happen?" to the jury during trial. James didn't have a chance.....because he was BLACK and couldn't afford adequate defense.  One witness got on the stand and refused to testify, then how could this have continued?? James filed an APPEAL but somehow the MOTION GOT LOST.
         "All people need to do is look into this, but it falls on deaf ears." James stated.

    Domestic Violence and How Survivors Navigate the Court System

    In Connecticut, 1/3 of all criminal court cases involve domestic violence. Everyday dozens of victims seeking help can’t get it and are turned away from critical services, including shelters. Earlier this month a report claimed that Connecticut shelters were at 150 percent capacity. Some agencies were trying to get hotel rooms because of a lack of space. Whether you call it family violence, domestic violence or intimate partner violence it is a serious health crisis in Connecticut.

    Jennifer Lopez is the Interval House Director of Court Advocacy Programs in Hartford. Jennifer has worked for 30 years on behalf of domestic violence victims in the court system both in criminal and civil proceedings. She says COVID created a backlog in the court system, and they are still catching up with all the cases. She says every case in court is different but the most important part of leaving an abusive relationship is having a safety plan.

    Jane Doe is a domestic violence survivor and is going through both criminal and civil court proceedings and says CT Paid Leave is invaluable. She says there are many court dates, and it makes it hard to take time away from work to attend them.

    The Family Violence provisions that CT Paid Leave offers to eligible workers in Connecticut includes 12 days of income replacement along with the Family Violence Leave Act that offers 12 days of job protection for these reasons:

    1.    To seek medical care or psychological or other counseling for physical or psychological injury or disability for the victim (survivor) 

    2.    To obtain services from a victim services organization on behalf of the victim(survivor) 

    3.    To move or relocate due to such family violence 

    4.    To participate in any civil or criminal court proceeding related to or resulting from such family violence.

    Navigating Civil and Criminal Justice Systems in Domestic Violence Cases

    Survivors of domestic violence often lack the resources to secure legal representation in either or both civil and criminal courts. And navigating the civil and criminal justice systems can be overwhelming for survivors. What's more, offenders in criminal domestic violence cases are entitled to attorney representation while their victims are not. To address the shortcomings of systems that do not adequately address the needs of survivors, organizations like the DC Volunteer Lawyers Project have stepped up to offer no-cost legal assistance that provides a holistic approach to representation. In doing so, survivors receive more than just attorney representation, they also receive advocacy, referrals to domestic violence services and help with child custody matters. We talk with attorney Jenny Brody for an understanding of what survivors need in these cases and how they can access appropriate resources. Ms. Brody also explains the importance of domestic violence training for law enforcement, attorneys and judges and how that training can improve outcomes for survivors.

    Jenny Brody has practiced family law in Washington, DC for more than ten years.  As the Co-Founder and Co-Executive Director of the DC Volunteer Lawyers Project, from 2008 to 2016, Ms. Brody provided legal assistance to hundreds of domestic violence survivors in Civil Protection Order cases, as well as in divorce, custody and child support matters.  As a member of the DC Superior Court Counsel for Child Abuse and Neglect Panel, Ms. Brody represented children as a court-appointed Guardian ad litem and also represented adoptive parents in adoption petitions.  Ms. Brody has devoted substantial time to improving the court system, as a participant in the DC Superior Court Domestic Relations and Domestic Violence Implementation Committees.  She also played a role in promulgating Guardian ad litem Practice Standards, through the Council for Court Excellence and in DC Superior Court. Ms. Brody is a recognized expert in domestic violence and family law issues, presenting numerous training programs in these areas for lawyers, judges, social workers, medical professionals and domestic violence advocates. Prior to practicing family law, Ms. Brody worked in private practice, at Rogovin, Huge & Schiller and at Powers, Pyles & Sutter.  She also served as an attorney at the United States Department of Justice, Civil Appellate Staff.  She clerked for the Hon. Irving L. Goldberg, of the United States Court of Appeals for the Fifth Circuit.

    Vicci Bailey: Her Teen Son Flees Father's Home Twice And Is Not Being Heard, Where Is The DA Instead Of A Dead Body

         Slam the Gavel welcomes Vicci Bailey to the podcast. Vicci came on to the podcast to explain what really happens when you move out and leave your abuser. It turns into a vicious cycle of Family Court Hell. Her son who is autistic was removed from the home by CPS in January 2021 and hasn't been seen since. He has tried to run away and has been returned to the father twice. Her son has also attempted suicide three times while in the father's care.
        Vicci and her sons have been isolated during the 19 year marriage and now after the divorce. The judge lowered Vicci's spousal support to $700.00/per month however, the ex makes well over  $6,000.00/per month. The judge would like to end the spousal support.
         Going through three judges already, Vicci is now with Judge Costillo on the bench who has issued a GAVRON warning, forcing her to go back to work when she is already on worker's comp with nerve damage to her fingers, wrist and elbow. Family Court is violating the worker's comp order and the GAVRON is in violation until the Federal Court releases her.
        Vicci states, "what really happens when you leave and what you are in for and there will be no legal help whatsoever. This is a control issue and the judge does not care." Being a Domestic Violence and PTSD victim, Vicci is wondering why the DA isn't stepping in to transfer this case to CRIMINAL COURT as it is riddled with CSA and fraud and why is Family Court handling it.
       Vicci reiterates when a person wants to leave, "think again, you want to be able to protect your child, the kids are taken away and handed to the abuser and NO ONE IS HELPING HER SON and no one, not even siblings are allowed to contact him since January 2021. The system goes where the money is."

Anthony Bompiani, Esq. graduated from Saint Vincent College in Latrobe, Pennsylvania, earning a Bachelor of Science Degree in the field of Psychology. He earned his Juris Doctorate from the Thomas R. Kline School of Law of Duquesne University, and is licensed to practice law in the state of Pennsylvania.
         Mr. Bompiani was elected Magisterial District Judge in January 2016 to January 2021 in Westmoreland County,  district 10-2-01 and began his term in January 2016 that would last five years.
        He has previously been named to the National Trial Lawyers Top 100 Criminal Trial Attorneys and the National Trial Lawyers Top 40 Under 40 three years in a row.  Also he was recently featured in Forbes magazine and Mensjournal.

    Attorney Ingrid Irwin Speaks Out About How Sexual Assault Victims Need Their Own Attorneys And Her Book, Nolle Prosequi In

          Slam the Gavel welcomes back Attorney Ingrid Irwin from Ballarat, Victoria, Australia. The last time she was on the show was November 16th, 2021, Season 2, Episode #130. In this podcast we discussed her book, Nolle Prosequi in, which was published in 2020. The title of the book means "do not prosecute." This is a call to action and critically assesses the latest developments in the law in this area from 2018 to present day. This book is published under her name Ingrid Irwin.
          Attorney Irwin stressed the importance of sexual assault victims/victims of rape to have THEIR OWN ATTORNEY. The Prosecution in a Criminal Case IS NOT THE VICTIM'S ATTORNEY.  This must be made clear at the very beginning that the crime takes place. The victim should not go to the police, but to retain an attorney first.  This would save the victim from repetitious re-traumatizing of the incident.
        With two books written, Attorney Irwin is very passionate about victims getting justice the correct way  and that is that they have THEIR OWN ATTORNEY.

    Bill Coleman Discusses The Umbrella Of Parental Alienation---FIRST OF THREE EPISODES

         Slam the Gavel proudly introduces Bill Coleman from Great Britain.  Bill Coleman was living in Waterbury Connecticut  in 2002.  After finding out his wife was having an affair, he then filed for sole custody of their two children on a particular Monday morning.  However, the following Friday, only four days later, Bill found himself being accused of the sexual assault of his wife.
        What ensued  next was a custody case that went by the allegations of rape, which led to not only Bill Coleman's removal of his children to his wife, but into the realm of a criminal conviction. Even though passing a polygraph test as well as a sophisticated state of the art psychological and sexual testing of which he passed with flying colors, it was not admissible evidence.
        The corrupt legal system twisted what was supposed to be the truth into their own narrative. An INNOCENT man sent to prison for eleven years.  Bill then had begun to protest being labeled guilty by participating in a hunger strike lasting seven years, and to this day still remains the longest hunger strike in United States history,  while serving time in prison as an INNOCENT man.
         Bill talked about the corrupt Family Court system as well as his fall into the pit of the criminal justice system.  More to continue in the second episode....
