Navigating the SEC's Whistleblower Enforcement Wave: A Guide for Financial Institutions

Navigating the SEC's Whistleblower Enforcement Wave: A Guide for Financial Institutions

In this episode of The Consumer Finance Podcast, Chris Willis is joined by Partners Sheri Adler and Mary Weeks to discuss the recent uptick in SEC enforcement activity related to whistleblowers. They focus on the implications for financial institutions and other companies, particularly those targeted by the SEC for documents potentially restricting whistleblowers from reporting violations of securities laws.

Sheri and Mary provide insights into the legal framework of whistleblower protections and offer practical tips for companies to avoid potential pitfalls. They highlight the importance of drafting agreements that do not deter whistleblowing, ensuring internal consistency across all company documents, and considering the language in third-party agreements.

This episode also touches on the potential for similar enforcement actions from other regulators, such as the CFPB, underscoring the need for companies to take a broad, holistic approach to compliance.

    Reimagining Banking for Tomorrow

    Reimagining Banking for Tomorrow

At a time when how we pay for things and how we manage our money has increasingly become embedded into our everyday interactions, from using our devices for contactless payments to getting financial advice online, financial institutions are integrated into everything and yet in some ways less visible than they’ve ever been. To talk about what this means for institutions and consumers alike, we’re joined by Dan Roberts, Global Head of Business Banking for HSBC. In his role, Dan travels a lot to get perspective on financial trends around the world. Here he shares what it means to go beyond banking to meet the needs of an increasingly digital world powered by data, AI and tech-enabled information sharing.

Women Leaders in Payments: Carol Wang, Senior Leader Commercial Payments at KeyBank | Episode 244

Women Leaders in Payments: Carol Wang, Senior Leader Commercial Payments at KeyBank | Episode 244

My next guest for our Women Leaders in Payments series has both an entrepreneur and facilitator spirit, being born into a family of self-starters and go-getters that depended on their entrepreneurial ventures for their foundation. KeyBank Senior Leader, Commercial Payments Carol Wang started her career in marketing but her intrigue with payments quickly changed her trajectory.

One of Carol’s roles at KeyBank is to lead the Solutions Engineering Team – a dedicated department that provides end-to-end technical payment services. Why did Carol choose KeyBank? In a nutshell, she perceived the capacity to build her career the way she wanted to within the infrastructure of a large organization.

As for her guiding principles, there’s one tried and true principle that has been with her throughout her entire career, and one that has adapted as her career has matured. Regarding the tried and true one, Carol emphasizes the importance of looking at who you’re going to work with and for versus just focusing on the job itself. And the other? Having an opportunity that will allow you to make a scalable difference.

We also discuss her most eye-opening career moments – including a corporate case study she participated in that had some pretty interesting results regarding the typical male and female response. Don’t miss it!

Just before the end of last year, we spoke with Stephen Kohn. He is a leading whistleblower attorney and subject matter expert. He represents Danske Bank whistleblower Howard Wilkinson in the largest money laundering scandal in world history, and successfully represented Greek whistleblowers whose information triggered a $320 million sanction against Novartis drug company under the Foreign Corrupt Practices Act.

Opportunities in crypto for banks, FIs

Opportunities in crypto for banks, FIs

As interest and investment in cryptocurrency spikes this year, banks and financial institutions (FIs) must decide whether and how to become involved, or potentially lose revenue and customers if they opt out.

This is the message from Lawrence Pruss, senior vice president at Memphis, Tenn.-based Strategic Resource Management (SRM) in this week's episode of "The Buzz" podcast. SRM is a consulting firm for FIs and others in areas such as digital transformation, operational efficiency and payment technology.

Banks and FIs can boost their revenue by offering crypto trading and custody services, among other services,  Pruss tells Bank Automation News. "The opportunity isn't just defending their deposits, but there's opportunities to drive non-interest income in terms of trading revenue," he says.

There is also potential to attract new customers and increase customer engagement, Pruss notes, as well as help to retain existing clients. "That's an opportunity — when you've got those eyeballs on your mobile banking app — to be able to offer across all other sorts of products and services, maybe even education" on cryptocurrency, he tells BAN, which is still lacking in many cases.

Banks and FIs have been contacting SRM regarding its new service, Cryptocurrency and Blockchain for Financial Services, which advises on the use cases of crypto and blockchain technology and how to set them up, to be sure they're not written out of the script, Pruss says. Decentralized finance, which has sprung out of cryptocurrency and its underpinning blockchain technology, connects lenders and borrowers while facilitating other financial transactions, all without the involvement of a bank.

"We've got some real concern from our clients in terms of being disintermediated," Pruss says. "All of a sudden, you realize it's a very competitive environment."

Episode 1: Let's Talk FinCrime with Tipper X

Episode 1: Let's Talk FinCrime with Tipper X

In the first episode of NICE Actimize's podcast, Let's Talk FinCrime, our host Dave Ackerman will chat with Tom Hardin, AKA Tipper X.

Known as “Tipper X,” Tom became one of the most prolific informants in securities fraud history, helping to build over 20 of the 80+ individual criminal cases in “Operation Perfect Hedge,” a Wall Street house cleaning campaign that morphed into the largest insider trading investigation of a generation. As the youngest professional implicated in the sting, Tom was tasked with wearing a covert body wire on over 40 occasions to help the FBI bring down some of its biggest targets in the industry.

In a reunion of sorts, Tom was invited by the FBI-NYC’s office to speak to their rookie agents in 2016 and is now a global keynote speaker, corporate trainer and board advisor on behavioral ethics, compliance and organizational conduct and culture risk. Through rigorous self-examination, Tom took responsibility for his actions as a young professional, used the experience to transform his life and is now on an on-going journey into behavioral science and why employees sometimes make the wrong decision.

    Sustainability Applied with Anna Chashchyna

    Sustainability Applied with Anna Chashchyna

On this episode of the Climate Conscious Podcast we discuss with Anna Chashchyna her interesting and inspiring journey to becoming a sustainability consultant, helping businesses operate in a sustainable manner, reduce costs, and effectively manage their environmental and social risks. Anna is also an environmentalist, keynote speaker and host of the podcast Sustainability Explored.

After studying abroad, and facing the lack of employment opportunities in her chosen profession, she returned to Ukraine and launched her career in Sustainability. Initially she worked with a local bank developing their environmental and social management systems, before becoming an entrepreneur as an independent sustainability consultant.

She shares the lessons learned from persevering through the lack of demand for professionals in the environmental sustainability field. In the moment facing rejection seems like the end of the world but in retrospect you realise how the negative experience leads you to the right place.

Working in the field of sustainability, not everyone sees it value. Anna focuses her energy on those who recognise the importance of the environment and positive social impact.

Her advice to aspiring Sustainability Professionals:

    • Find your tribe that will provide emotional support along the journey
    • Be consistent and don't expect fast results. The compounding effect of consistent efforts will pay off.
    • Develop the skill of effective and respectful communication.

Anna also shares the important considerations for managing environmental and social impacts of renewable energy projects.  In the case of solar PV it is critical to consider the project life cycle, particularly the end of life of the pv panels.
