    People often think that HIPAA is there to help prevent people from finding out about their personal information.  In actuality, the law actually focuses on the "portability" and "accountability" of such data, and where and how it can be shared.  In casual lingo, people often joke around, "oh that's HIPAA" or "that's a HIPAA violation," and even medical offices sometimes refuse to send records without a signed release (which isn't required by HIPAA when it is going to another treating provider).

    But of course, HIPAA Is one aspect.  Did you know by law you have a right to NOT have your treatment information sent to your insurance company?  Did you know that you can access your entire medical record?  Did you know hospitals are required by law to show their prices transparently, but as for now, many hospitals are still not compliant?

    In this engaging conversation with Dr. Phil Eskew (direct primary care doctor, lawyer and businessman), we will explore some of these key legal issues that impact the world of health care so that as a consumer, you are more informed of what that looks like and means.

    At the Crossroads of Health and Tax Law (Katherine Pratt)

    Professor Katie Pratt is Loyola Law School’s Sayre Macneil Fellow. She is an expert in income taxation and tax policy, and the co-author of a popular textbook on income tax. She writes on the intersection of tax law and population health, tax expenditures and federal budget issues, with the goal of improving policy. Focusing on what she calls “scholarship with a heart,” Pratt explores the consequences of tax policies on health issues affecting wide swaths of the population. Her work is uniquely interdisciplinary: a member of the American Public Health Association as well as the National Tax Association, she studies and writes about the use of taxes on soda and junk food to control obesity, as well as the tax treatment of medical expenses for gender reassignment and fertility treatments.

    The Issue.
    The Centers for Medicare & Medicaid Services issued a final rule that sets a new direction for the Medicare Shared Savings Program, including wholesale changes to the “track” model previously used for accountable care organizations.

    Why It’s Important.
    The final rule dramatically changes the current ACO framework, and providers who participate must understand the differences from the previous rule. Increased risk has been added to the program, meaning providers should ensure they are fully informed of the program’s new structure.
