    Legal Minute: 4 Must Do's When Choosing a Predicate Device for Your 510(k)

    Darshan Kulkarni delves into the recently released draft guidance by the Center for Devices and Radiological Health (CDRH) outlining best practices for selecting a predicate device when preparing a 510(k) submission. This guidance underscores four key considerations.

    The draft guidance emphasizes the significance of technological characteristics. If the new device shares the same technological characteristics as the predicate device, the 510(k) summary should include a comprehensive summary of these features.

    Design-related recalls take center stage in the FDA's recommendations. The agency discourages choosing a predicate device that has been subject to a design-related recall. If a submitter opts for such a device, they must explicitly address how they've mitigated the safety concerns that led to the recall.

    Transparency and documentation constitute the third crucial consideration. The FDA stresses the need for a detailed 510(k) summary that provides a comprehensive understanding of the basis for determining substantial equivalence.

    The guidance encourages the inclusion of a narrative explanation in the 510(k) summary. This narrative should elucidate the process behind selecting the predicate device, offering transparency and insight into the decision-making process.

    Dr. Woodruff was born in Arkansas.  He completed his residency at both Louisiana State University and Oschner Medical Center.  From there, he completed a robotic and minimally invasive urologic oncology fellowship at The Virginia Mason Medical Center in Seattle, Washington.  Upon finishing his fellowship, Dr. Woodruff moved to Northwest Arkansas where he practiced until 2012 serving as the Director of Robotic Surgery at Northwest Medical Center.  Shortly after that, he moved to the desert with his family and now has his own practice called Woodruff Urology in Mesa, Arizona.

She initially broke into medical sales when she was working at Barrow Neurological Institute at St. Joseph’s Hospital.  She networked with reps while there, stayed persistent and was given an opportunity. She initially broke in at stryker, moved from there to integra, and now she is at Hologic selling capital and disposables in the breast cancer space.  She sought out a job at Hologic because She has always been passionate about women’s health.   She talks about her own experience with networking and being persistent to break into the Medical Sales Industry!

    Brian Murdock: “Hooah” - How to Break into Med Device Sales from the Military

    Went from the Army to Med Device Sales.  Before breaking into Med device, Brian enlisted in the army in 2003 and worked his way up the ranks commissioned as an Officer in 2007.  He served multiple assignments in the US and in the Middle East.  During this time, he developed his leaderships skills, while leading multiple, dynamic - cross functional teams. In 2015, Brian decided to take his career in another direction and that is when he broke into Medical Sales.  Brian was first hired as a territory manager by AMS, which was later acquired by Boston Scientific.  During his first three years, he received the Men's Health Sales Achievement Award back to back in 2016 & 2017.  Finishing in the top 15% of the National Sales force and number one in his region.  Brian is now the Regional Manager at Boston Scientific and still serves part time in the army reserves & was just recently promoted to Major.  The intent of this episode is to show that breaking into Medical Sales from the Military IS possible & hopefully we can leave those, who are entering the unknown job market, with renewed hope!

    Sarah Stringham: #2 Rep in the Country Breaks into Medical Sales

    Sarah started out her Sales Career as an associate sales representative for British Petroleum.  At British Petroleum she supported 7 territory managers, assisting the district to finishing 105% to plan in 2017, all while being asked to back-fill the positions of two territory managers within the district. After stepping up to the plate and over-performing, she was promoted to a territory manager. While in that position she also managed 5 distributor reps and finished at 138% to plan and was ranked #2 in the country for territory growth. She was hired by Boston Scientific in 2019 as an Associate Sales Representative and was quickly promoted to a Territory Manager 7 months later.  It is very common for candidates to be told that they either do not qualify for the job because of their lack of sales experience.  We will be getting Sarah's perspectives about all of this – from someone that has already had success in two very different sales industries.
