Claims manager Kurtis Marshall brings us part two of a two part series involving a case that lasted for 14 years.  In this episode Kurtis discusses the trial that resulted from the challenges that multiple providers faced when attempting to provide care to a patient who included their adult child in their visits for a condition that ultimately developed into cancer.  Issues surrounding documentation and patient relationship termination are addressed as we discuss this case. 

Today’s interview is with political consultant Shawnda Westly. She tells her heartbreaking story of medical malpractice and an in-depth look at California’s Medical Insurance Compensation Reform Act. MICRA limits the amount of money patients can receive in damages. She discusses how MICRA works, including some parts that are relatively unknown, why the laws should be changed, what type of resistance there is to change the law, and how monopoly power affects change.
