    Govt asks High Court to rule on new immigration detainees case

    The federal government found itself under fire again this week over last year's High Court ruling that freed close to 149 people being held in indefinite immigration detention. 

    Media reports this morning indicate that the government has asked the High Court to rule in another case, that could see up to 340 people held in long-term detention freed.

    Why Thailand's Move Forward Party can't move forward

    They were the party for change and were willing to put the institution on notice. 

    The Move Forward Party exceeded expectations at the Thai general elections last May winning the most seats. However they failed to form a coalition government.

    They had also pledged at the elections to amend the country's lese majeste laws, which carry penalties of up to 15 years in jail for criticising the royal family.

    But this week the country's Constitutional Court rejected the move, saying the party's policy amounted to an attempt to overthrow the democratic regime of government with the King as head of state.

    Russia’s ban on the ‘LGBT movement’

    On November 30, the Russian Supreme Court outlawed an organization that doesn’t exist: the so-called “international LGBT movement.” The ruling came in response to a lawsuit filed by the Justice Ministry, which claimed the “international LGBT movement’s” activities showed signs of “extremism” and incited “social and religious discord.”

    The new ban won’t officially come into force until January 10, 2024, but its chilling effect was almost immediate. The day after the ruling, Russian police reportedly raided multiple nightclubs that were hosting events for LGBTQ+ people. One of St. Petersburg’s oldest gay clubs has announced its closure, as has at least one LGBTQ+ rights organization. The mapping service 2GIS instructed employees to create a “registry” of LGBTQ+ establishments.

    According to the Russian authorities, this human rights crackdown is necessary to protect Russia’s “traditional values” from outside threats. But the truth is that this type of conservative nationalism didn’t originate in Russia at all. To learn where it actually came from and what it means for LGBTQ+ life in Russia, Meduza senior news editor Sam Breazeale spoke to historian Dr. Dan Healey, sociologist Dr. Alexander Kondakov, and political scientist Dr. Leandra Bias.

    The Supreme Court has ruled that the former Mainzeal directors are liable to pay $39.8million plus interest and costs as compensation after the collapse of the company a decade ago.

    The directors’ cross-appeal was dismissed as the Supreme Court found that they were aware of the company’s precarious position.

    Former Prime Minister Jenny Shipley was one of Mainzeal’s directors and has been ordered to pay up to $6.6million.

    DLA Piper Litigation and Regulatory Partner Alicia Murray told Heather du Plessis-Allan that this brings directors’ duties into focus.

    SCOTUS Affirmative Action Decision, All4Ed Flash, S1, E2

    On Thursday, June 29th, the Supreme Court issued an opinion ruling that the race conscious affirmative action policies used by Harvard and the University of North Carolina were unconstitutional.  While these cases were focused on these two university’s specific policies, the ruling will have far reaching consequences for every college and university across the country that uses race as a factor in holistic application processes. In a 6:3 ruling by the conservative majority, Chief Justice John Roberts claims that their ruling does not overturn prior cases authorizing race-based affirmative action and that how an applicant’s race has affected their life can still be part of how their college application is considered.  

    However, the dissenting opinions and initial analyses claim that this opinion overturns over 40 years of precedent and will make it nearly impossible for colleges and universities to use admissions policies as valuable tools to increase diversity and ensure equitable consideration of student candidates.  

    In a rare move, the justices read their dissenting and concurring opinions from the bench. In her dissent, Justice Sonia Sotomayor said “The result of today’s decision is that a person’s skin color may play a role in assessing individualized suspicion, but it cannot play a role in assessing that person’s individualized contributions to a diverse learning environment. That indefensible reading of the Constitution is not grounded in law and subverts the Fourteenth Amendment’s guarantee of equal protection.” 

    Education Secretary Miguel Cardona said it best in his message to aspiring students, “we see you and we need you. Do not let this ruling deter you from pursuing your educational potential. Our colleges and our country itself cannot thrive and compete in the 21st century without your talent, ingenuity, perseverance, and ambition.”

    While Thursday’s decision will be studied in more detail in the coming days and weeks, what is certain is that higher education leaders must continue their commitment to creating campus communities that reflect the diversity of this nation. 

    Whether they are Black, Latinx, Asian American, Native Hawaiian, Pacific Islander, Indigenous, or White, every young person still deserves a fair shot at higher education. This decision should not deter young people from applying to colleges and universities or from fully expressing themselves in their college applications and sharing their talents, experiences, how they would contribute to the university community, and how race affects their lives.
