    It is axiomatic that if you want to have a successful legal career, you need to learn your craft. Most areas of legal practice require highly refined analytical abilities coupled with good judgment. For the most part, the first developmental task of any new lawyer is to learn how to practice law.

    But if you want to advance in your career, you need to be more than a good technician.  Demonstrating executive presence is also key.

    In this episode, I am pleased to introduce John Buckley, Board Secretary and General Counsel for the North Carolina operations of a multinational mobility infrastructure company.  John talks about how building your executive presence is critical to advancing your career, especially if you want to want to take on leadership responsibilities.

    In a great conversation, John discusses what executive presence is, who needs it, and what it looks like. He offers his practical tips on how increase your own executive presence.

    Over the summer, I heard John give a great presentation on this topic for the American Bar Association and I decided I had to have him on the show.  Lucky for me, he accepted my invitation right away.

    John Buckley has served 3 times as the first in-house counsel for start-ups.  He has 15 years of solo/small law department General Counsel experience.  He began his professional life as an engineer for Duke Power.

    Prior to joining Washington and Lee, Maria served as Vice President, General Counsel, Secretary, and - for two years - as Interim Athletics Director of the University of Hartford, an institution with seven colleges offering over 100-degree programs, students from 48 states, 63 countries, and a robust Division I Athletics program. There she was responsible for oversight of the Office of General Counsel, Office of Equal Opportunity Programs and Title IX Compliance, Athletics Department, Office of the Secretary, Compliance and ERM Programs. As Athletics Director, she oversaw a budget of over $22 million, managed over 75 full time employees and 17 Division I Athletics Programs, launched new Diversity, Equity, and Inclusion initiatives and a new Varsity Esports Program, funded and built a new Esports arena, and celebrated the men’s basketball team’s first ever NCAA Tournament appearance and America East Championship win.

    Prior to joining Hartford, she served as the Chief Legal Officer of Florida A&M University, one of the largest HBCUs in the country.

    From 2007 through 2017, Maria was a partner in the Am Law 100 law firm Pepper Hamilton, where she chaired the Women’s Initiative, was vice chair of the Diversity Committee, and was on the Hiring and Contributions Committees. She was a senior legal consultant for FGIS, a risk management company former FBI Director Louis Freeh founded, and Pepper acquired. With FGIS, she served as a senior consultant for the Deepwater Horizon Economic Claims Center in connection with the largest court-supervised settlement program in U.S. history following the BP oil spill.

    In 2014, the Pennsylvania Governor appointed her to the State Ethics Commission, an independent agency which enforces the Ethics Act, and certain provisions of the Lobbying Disclosure Law, Gaming Act, and Medical Marijuana Act.

    Philly Biz named her a “Top Business Attorney;” Profiles in Diversity Journal honored her in its 10th Annual WomenWorthWatching® issue; The Legal Intelligencer and Pennsylvania Law Weekly named her one of Pennsylvania’s 25 Women of the Year in 2008; she received the Philadelphia Bar Association’s Peretta Award, was appointed Philadelphia liaison to the ABA’s Commission on Women, co-chair of the 2010 ABA Women in Law Leadership Academy Programming Committee, Zone 1 Delegate to the Pennsylvania Bar Association House of Delegates; she was elected to the Board of Governors of the 13,000 member Philadelphia Bar Association, appointed to the Committee on Judicial Selection and Retention, and chaired the Association’s Women in the Profession Committee, Annual Bench Bar Conference, Women’s Rights Committee, Sandra Day O’Connor Award Committee, and Drafting Committee for the Development of a Call to Action and Best Practices for the Retention and Promotion of Women Lawyers.

    Maria obtained her JD from Washington and Lee University where she served as senior articles editor for the Washington and Lee Journal of Civil Rights and Social Justice f/k/a Race and Ethnic Ancestry Law Digest. She obtained her BA, cum laude, in Mathematics and History from Rosemont College, where she received a full-tuition academic scholarship, was inducted into the Delta Epsilon Sigma national honor society and was an adjunct business law professor from 2006 through 2015.

    Prior to joining Google, Bert was General Counsel and a member of the executive leadership team of ServiceMax Inc., a California based cloud application provider, where he was responsible for all legal affairs of the company including privacy and technology related legal issues.

    Earlier, Bert was Chief Commercial Counsel at GE Digital LLC, a General Electric company, where he served as GE Digital’s privacy leader and specialized in the Industrial Internet of Things, cloud computing, and software licensing.

    Bert began his in-house legal career at Oracle. Bert established and led Oracle’s Cloud Legal team, and as Assistant General Counsel, served as the principal attorney globally for Oracle’s cloud computing and information technology managed services businesses. 

    Bert served as an appointed member of the Privacy Bar Advisory Board of the International Association of Privacy Professionals (IAPP), and is also an IAPP Certified Information Privacy Professional for European data protection (CIPP/E).

    A graduate of Fordham University’s joint J.D./M.B.A. program, Bert earned a certificate from the Massachusetts Institute of Technology (MIT) on the topic of Artificial Intelligence and its implications for business strategy.     “I was really thankful to have the association because we were all talking with each other and sharing information about what we were doing. And so it was really helpful as the pandemic was hitting - in late February and early March of 2020 - [to be] talking to each other about what we were seeing internationally from our clients, from other firms.”

    “The first place I start is looking at the business. What does the business look like today? And what do they need first and foremost? And then from there, start looking at more of the nice to haves. Is there something else where there's real revenue, but it's really not connected to our business? Where can we turn the portfolio itself into an asset separate from our business?”

    How he thinks about monetizing valuable patents:

    “In general, you start to map out the market. The first place you look at with any deal is who are the infringers? What does the market look like for these claims? Who needs the claims? Who's practising the claims? And what does that market look like? Who are the big players? And also, who is in need of a portfolio like this?”

    Finding the right balance for the client relying on outside counsel:

    “There's this kind of dance that will happen at certain points in prosecution with an examiner where you have to kind of really quickly make some decisions on the fly about what deals to make with an examiner . . .how to change scope here and there a little bit.  I think ideally you want to empower your outside counsel to be able to have a little bit of leeway with examiners so that, so that that dance can happen.

    I think it's really powerful if you can empower your counsel to do that.”
