How To Stop Government Profiteering Off Late Tax Bills
Pacific Legal Foundation attorney David Deerson explains their case before the US Supreme Court that will decide if governments can profit from property seized over delinquent property taxes. The case at hand is Tyler v. Hennepin County, where an elderly woman was unable to keep up with the property taxes on her condo. The local government seized the home, sold it, and kept all the proceeds even though that exceeded the amount of taxes due. Currently, this practice is legal in Minnesota. https://pacificlegal.org/case/mn_home_equity_theft/

5-23-22 Who Is Henry George? Architect Of Communitarianism Or Innovator Of Economic Equality

5-23-22 Who Is Henry George? Architect Of Communitarianism Or Innovator Of Economic Equality

Henry George (September 2, 1839 – October 29, 1897) was an American political economist and journalist. His writing was immensely popular in 19th-century America and sparked several reform movements of the Progressive Era. He inspired the economic philosophy known as Georgism, the belief that people should own the value they produce themselves, but that the economic value derived from land (including natural resources) should belong equally to all members of society. George famously argued that a single tax on land values would create a more productive and just society. In this podcast, we'll begin our exploration of George and his work and how it's being welded into certain communitarian models.

Progressive Taxation: What is it? Why would we want it? Do we have it?

Progressive Taxation: What is it? Why would we want it? Do we have it?

Scott and Jeff discuss progressive taxation. While most agree progressive taxation is desirable, there is less agreement about how much progressivity is desirable, what it even is, and if our current tax system is progressive.  Scott and Jeff tackle these issues by asking each other questions about taxes on income, property taxes, taxes on cigarettes, and other scenarios. They conclude that progressivity is a slippery subject, and, claims about progressivity should be carefully considered.

Five Minute Friday #55 - Summary of California's Proposition 19

Five Minute Friday #55 - Summary of California's Proposition 19

California's Proposition 19, goes into effect on April 1, 2021,  offering many protections to California home owners. If you are a California homeowner or investor, could you take advantage of the new benefits provided under this new law? Today's Five Minute Friday offers a quick summary of what Prop 19 is all about.

    1. Senior citizens often live in homes that are no longer a fit because it may be too large or far away from loved ones or medical providers.

    2. Severely disabled individuals might live in a residence that is no longer safe or suitable.

    3. California wildfire victims, possibly losing everything if their home was destroyed, could have property tax hikes if they desire to move to a new home.

Because of these new advantages and if you meet any of the criteria above, this might be the time to selling your California home, even if it is a rental home or a vacation home.

Have a listen to learn more about Proposition 19. If you are interested in taking advantage of Proposition 19 by selling your rental home or buying an investment property, our real estate sales division can help!

Episode 60: Starting in property series - Considering your inputs
Stuart and Simon try to look at resources that you need to consider when planning property investment and get a little sidetracked into discussing personal vs limited company ownership of investment property. The discussion this week included: * The resources needed to invest in property. * Time. * Money. * Knowledge/expertise/experience. * The best knowledge comes through doing. * Doing means walking the streets. * Using agents, or not. * Self listing properties - OpenRent (https://www.openrent.co.uk/), LettingAProperty (https://www.lettingaproperty.com/), UPad (https://www.upad.co.uk/), Visum (https://www.visum.co.uk/). * Differing costs and effort between buying in personal names or a limited company. * Section 24 (https://docs.patma.co.uk/glossary/section-24/). * Tax! * Some of the company vs personal tax considerations. * Capital Gains Tax rates (https://www.gov.uk/capital-gains-tax/rates). * Transferring property into a limited company. The Confusing Yet Urgent Challenges of Prop 19

The Confusing Yet Urgent Challenges of Prop 19

    My first episode of 2021!

This episode tackles the murky but pressing topic of California's Proposition 19. As of this episode's recording, the enormous changes to reassessment rules and parent-to-child property transfers in California are set to take effect in mere weeks, on February 16, 2021.

At this time, there are more unanswerable questions than there are answerable ones. Even the (unmistakably competent) Assessor for LA County - in a recent webinar - admitted that most California counties don't know how Prop 19 will be handled. This proposition passed on last year's ballot with approximately 51% of the vote but hardly anyone understood it fully. It was sold as a relief measure for wildfire victims and responders but the messaging behind it obscured the whole truth.

Adult children in California have long enjoyed the ability to pay the same property tax rates as their parents did following an inheritance or gift of real estate. Under Prop 19, this will be considerably less true. Real property will be reassessed at its full market value under all but the narrowest of circumstances.

Can the Creation of the California Fire Response Fund Lead to a Tax Increase? What You Should Know About Prop 19

Can the Creation of the California Fire Response Fund Lead to a Tax Increase? What You Should Know About Prop 19
The California voters passed Prop 19, also known as the California Fire Response Fund proposition, which goes into effect in 2021. This proposition can have surprising effects on property tax and estate planning as it relates to transfers to children. On this episode of CalCurrent, private client services partner, Steffi Hafen, discusses the history that brought us to Prop 19, and the effects it can have on California homeowners.

    British Land’s robotic automation process

    British Land’s robotic automation process

Smith & Williamson worked very closely with British Land this time last year designing, implementing and running a robotic automation process for the submission of approximately 240 of British lands tax computations. Sally Cowan at British Land led this project so I thought it'd be really helpful to hear Sally's views on the process on what went well, where we added value and of course, what we can do better this year.

Documentary chronicles rise of the tax revolt and the legacy of Howard Jarvis

Documentary chronicles rise of the tax revolt and the legacy of Howard Jarvis
The documentary “The First Angry Man” turns its lens back on the moment when Proposition 13, which dramatically restricted property taxes, was passed and examines the social and political context of the time. The filmmakers, Camille Servan-Schreiber and Jason Andrew Cohn, make the case that Howard Jarvis, the public face of Proposition 13, helped usher in an era of nationwide tax revolt and distrust in government that persists more than 40 years later. The documentary comes ahead of an election in which California voters will consider a ballot measure that would amend Proposition 13 to raise property taxes for some businesses.
