    LA CORTE SUPREMA ABBATTE IL RAZZISMO DEGLI ANTIRAZZISTI di Stefano Magni
    Alla fine di giugno, la Corte Suprema ha dato un'altra picconata al progressismo americano. Ha dichiarato incostituzionale la discriminazione positiva, su base razziale, nelle selezioni per accedere alla prestigiosa università di Harvard. Con la sentenza Students for Fair Admission vs. Harvard, la "affirmative action", o discriminazione positiva, in uso nel mondo dello studio e del lavoro sin dagli anni '60, è stata delegittimata. La sentenza ha provocato un vivace dibattito che mette a confronto due modi opposti di intendere il razzismo.
    La sentenza della Corte Suprema, votata da 6 giudici supremi contro 2, ne ribalta due precedenti che avevano fatto la storia. La prima, Regents of University of California vs. Bakke del 1978, aveva stabilito il principio che una certa preferenza razziale negli esami di ammissione fosse ammissibile, purché non fosse una vera e propria quota. Nel 2003 questa posizione era stata ribadita in un'altra sentenza, la Grutter vs. Bollinger. Tuttavia, in nessuna di queste sentenze la discriminazione positiva veniva assunta come principio. Si sdoganava l'eccezione, semmai, ma sempre sul filo del rasoio della costituzionalità. Quindi l'università poteva esercitare delle preferenze per diversificare la sua popolazione studentesca e avvantaggiare le minoranze più sfavorite (i neri, soprattutto), purché non fosse una pratica sistematica, fosse "limitata nel tempo" e non determinante nella selezione.
    DISCRIMINAZIONE POSITIVA
    Questo criterio è andato bene a tutte le minoranze, finché non ne ha colpita una molto grande e sempre più influente: quella asiatica. Infatti è proprio un caso di discriminazione di studenti di origini asiatiche, mediamente "troppo bravi", nell'esame di ammissione dell'Università di Harvard, nel 2014, che ha dato origine alla causa che solo alla fine del mese scorso è giunta alla sua conclusione in Corte Suprema, dopo un percorso tortuoso di sentenze locali e federali. L'associazione Students for Fair Admission ha vinto. Il massimo organo giudiziario americano ha sentenziato che la discriminazione positiva negli esami di ammissione viola sia la Costituzione (Quattordicesimo Emendamento, che ribadisce l'uguaglianza di tutti i cittadini di fronte alla legge) che l'articolo 6 della Legge sui diritti civili del 1964 che vieta ogni discriminazione su base razziale.
    Nel parere di minoranza, la giudice suprema liberal Sonia Sotomayor ritiene che questa sentenza "rafforza ulteriormente la disuguaglianza razziale nell'educazione". Le fa eco lo stesso presidente Joe Biden, che si dice apertamente in disaccordo con la Corte Suprema. La nuova rettrice di Harvard, Claudine Gay, dichiara in un video che questa sentenza "implica la possibilità concreta che molte opportunità vengano negate". C'è preoccupazione soprattutto per i neri, che verrebbero sotto-rappresentati nelle università. Secondo i test attitudinali Sat, nel 2022 gli afro-americani conseguivano una media di 926 punti su 1600, contro una media di 1098 punti per i bianchi e ben 1229 punti per gli asiatici. Quel che le università più prestigiose temono (e i posti di lavoro che reclutano presso di loro, anche) è un'università con gli occhi a mandorla? Parrebbe di sì.
    50 ANNI DI DISCRIMINAZIONE A FAVORE DEGLI AFRO-AMERICANI
    Prima di tutto occorre chiedersi se quasi 50 anni di discriminazione positiva a favore degli afro-americani e in misura minore dei latino americani, abbiano portato a una emancipazione di queste minoranze. La risposta è quasi sempre negativa, considerando che fra gli afro-americani è più alta la percentuale di abbandono degli studi ed anche se ammessi in una corsia preferenziale, finiscono poi in fondo ai loro corsi. Forzando l'ammissione "si introducono nelle università studenti neri che, in un mondo senza discriminazione positiva, frequenterebbero scuole meno selettive, ma perfettamente rispettabili", come scrive su Wall Street Journal Heather McDonald, del Manhattan Institute. "In quasi 50 anni di retorica favorevole alla discriminazione positiva, molti studenti neri si sono convinti che essere respinti da una scuola per un brutto voto sia come essere respinti per il colore della loro pelle". Questo meccanismo ha dunque accentuato la disuguaglianza, non ha ridotto le distanze.
    L'anti-razzismo dei progressisti va poi in cortocircuito proprio con la causa intentata da Students for Fair Admission, che ha agito in rappresentanza di studenti asiatici. La minoranza asiatica è "privilegiata"? No, perché è formata da discendenti di lavoratori forzati (i coolies cinesi), immigrati indiani poverissimi, profughi del Sud Est asiatico. Sono i nuovi self made men, sono cresciuti dal nulla, basandosi sulle loro capacità personali e la loro instancabile voglia di studiare e lavorare. Per questo sono minoranze che evidentemente non piacciono ai progressisti. A coloro che vogliono bene ai poveri, purché restino poveri.
