    #BiroscaNews 228: "In Dubio Pro Societate"? STJ rejeita essa "tese"
    No vídeo, abordaremos um julgamento importante no Superior Tribunal de Justiça (STJ) relacionado ao entendimento do "princípio" do "in dubio pro societate" no processo penal brasileiro. Foi no contexto do julgamento do REsp 2.091.647/DF que a 6ª Turma do STJ, em votação unânime, tomou uma decisão significativa, acompanhando o voto do ministro relator Rogerio Schietti Cruz. O ministro Schietti Cruz ofereceu uma análise detalhada sobre o sistema da íntima convicção e do controle das decisões do Tribunal do Júri, estabelecendo parâmetros para o standard probatório necessário para um juízo positivo de admissibilidade ao final do iudicium accusationis. No final, o ministro concluiu pela inexistência do suposto "princípio" do "in dubio pro societate."
    Esse precedente se junta a outras decisões importantes, como a decisão monocrática do ministro Gilmar Mendes no HC 227.328/PR e o julgamento do ARE nº 1.067.392/CE no Supremo Tribunal Federal (STF). Ambas as instâncias rejeitaram a existência do "in dubio pro societate" no rito escalonado do Tribunal do Júri.
    Exploraremos a importância dessas decisões à luz da Constituição Brasileira e dos princípios fundamentais do processo penal. Vamos discutir como o entendimento do "in dubio pro societate" pode afetar a presunção de inocência, o ônus da prova e a garantia de um julgamento justo. Também discutiremos o papel do juiz togado na avaliação das acusações formuladas pelo Ministério Público e como isso se relaciona com a formação de indícios suficientes de autoria ou participação. Este vídeo ajudará a esclarecer o debate em torno desse princípio controverso no direito penal brasileiro.

    Evictions, Foreclosures, Student Loans & Relief Packages - Episode 255

    Evictions, Foreclosures, Student Loans & Relief Packages - Episode 255

    Will evictions and foreclosure ever resume?

    Since being inaugurated, President Biden has by executive order extended federal moratoriums on evictions, foreclosures, and student loan repayments first implemented by the CARES Act, the CDC, and the previous administration.

    Although recorded recently, some of the timelines in this episode have already changed.  As of this post:

    • Evictions for purposes of COVID are postponed under CDC guidelines until March 31, 2021 (although rumor is this will extend to September 2021);
    • Foreclosures are postponed until February 28, 2021 or March 31, 2021 depending on the owner of the loan; and
    • Student Loan payment, interest, collection on federal loans held by the US Department of Education are suspended until September 2021.

    What should you know?

    Evictions - the CDC prevents evictions if the reason for eviction is due to a loss of income caused by COVID. This only impacts residential evictions, and the CDC has five requirements that the tenant must attest to under penalty of perjury. If one of those five requirements is missing, it is probable that the tenant could still be evicted.

    The CDC has not (and cannot) eliminate the requirement to pay rent. There is rental assistance available to the tenants to catch up on most or all of their unpaid rent.

    Foreclosures - FHA and FHFA have suspended all foreclosures and bank-owned evictions until February 28 or March 31, 2021 (unless extended again). The CARES Act requires lenders to offer a repayment plan, and many lenders can modify the loan, but cannot require a lump sum to catch up past due payments missed due to economic factors caused by COVID. The CARES Act does not eliminate the requirement to pay mortgage payments.

    Student loans - For federal loans owned by the US Department of Education, there is a suspension of payments, interest accrual and collection, until October 2021.

    Why It Is Important For Realtors To Get Into REO & Short Sales | Interview with Ben Barber and Joshua Smith.

    In this GSD Mode Podcast Interview we break down and answer the question of why we feel it is extremely important for Real Estate Agents to get into REO and Short Sales and make it a part of their Real Estate Business. If you want to create a "Recession Proof" Real Estate Business, this is essential in my opinion. The reality is that Real Estate itself is always selling and is always trading hands, there is no such thing as a good market or a bad market, instead we as Real Estate Professionals need to identify "Whom The Market Is Good For" and pivot our energy, focus and efforts to where the opportunities are at.

     

     

    I got into the Real Estate Industry in 2005 (this is Joshua Smith writing this just in case you didn't know LOL) and in my first 2 years, the real estate market was on fire, prices rising rapidly and I had a lot of success helping traditional Buyers and Sellers... Then, my 3rd year into the Business, things shifted quickly, we went from one of the biggest Real Estate Booms in recorded History to the biggest Real Estate Market Crash in recorded history... I had to quickly learn and pivot my focus to REO's and Short Sales, which I did and went from being one of the Top Traditional Agents in our market to now one of the Top REO and Short Sale Agents in our market... It took a lot of work to do this, but it was 100% worth it and I was able to continue to grow and scale my Real Estate Business each and every year regardless of the fact that we were in a massive real estate market crash (what now is referred to as the "Great Recession")...

     

     

    Just because the "Economy" is experiencing a downturn, does not mean your personal Real Estate Business shouldn't continue to grow and flourish, and it 100% should always continue to grow as long as you are willing to make the right adjustments within your Business.

     

     

    This is the 1st Podcast that Ben and I are doing in a multi part series, where each week we are going to release another Episode with more Tips on how to have massive success with REO and Short Sales inside your Real Estate Business...
