    David Rybicki and Neil Smith of the law firm K&L Gates discuss the new Department of Justice Safe Harbor Policy for voluntary self-disclosure made in connection with M&A.     After failing at privacy, again, Google is working to keep Bard chats out of Search

    Google's Bard chatbot is currently being re-educated to better understand privacy.

    In July, Bard gained the ability to share conversations with other people using a unique public link. Unfortunately, Google Search has indexed those shared links, making them more widely available and discoverable than Bard patrons might expect.

    At least such oversights don't happen all that often at Google, which has a 33-page privacy policy [PDF] detailing how much the company values user privacy. Apart from an $100 million biometric privacy settlement with Illinois in April 2022, an $85 million location data settlement with Arizona in October 2022, a $391.5 million privacy settlement in November 2022 with a 40-state coalition of Attorneys General, and $29.5 million to settle location tracking claims in Indiana and Washington DC, you have to back all the way to 2019 – when the FTC settled with Google and YouTube for gathering kids info without consent – to find substantive privacy issues at the 25-year-old search advertising biz.

    Frankly, the presence of Bard chats in Google Search barely rates on a list of text ads giant's greatest privacy misses, which includes Street View cars collecting sensitive data from Wi-Fi networks and combining its ad data with Google user's personal data.

    China's national security minister rates fake news among most pressing cyber threats

    This story in a meme:

    Chinese minister for national security Chen Yixin has penned an article rating the digital risks his country faces and rated network security incidents as the most realistic source of harm to the Chinternet – both in terms of attacks and the dissemination of fake news.

    The new article reiterates Xi Jinping's thoughts on network and cyber power, which boil down to a recognition of the internet's central role in almost all aspects of modern life and the subsequent need for security and governance.

    In China governance includes restrictions on free speech and detection and deletion of information felt to be incorrect. Or as minister Chen put it, after machine translation: "The internet has increasingly become the source, conductor, and amplifier of various risks. A small incident can become a whirlpool of public opinion. Some rumours can easily turn a 'storm in a teacup' into a 'tornado' in real society."

    Chen's article rates "increasingly fierce competition between great powers in cyberspace" as the most significant competitive threat China faces in the digital domain. He accused rivals of using "so-called 'risk removal' as an excuse and using ideology as a standard to create technology 'small circles' such as 'Clean Network' and 'Chip Alliance,' and even expanded the use of policy tools such as export controls, security reviews, and restricted exchanges."

    The minister argues such initiatives are motivated by other nations' desire to cement technology leadership positions and build monopolies, rather than genuine concerns.

    Sundie Seefried is Founder and President/CEO of Safe Harbor Financial, the leading provider of reliable financing solutions to the cannabis industry.

    A 39-year credit union industry veteran, Seefried was the former CEO of Partner Colorado Credit Union (PCCU). Established in 2015 by PCCU, Safe Harbor was formed to provide an unmet need – compliant banking and financial services to the rapidly growing U.S. cannabis industry.     Seefried regularly provides cannabis banking education and expertise to legislators, regulators, attorneys generals, state officials, and financial institutions. She is on a mission to normalize banking for the cannabis industry, while assisting law enforcement and federal agencies to be more effective at combating illicit activities and protecting the financial system.

    To share her knowledge, Seefried authored the book ‘Navigating Safe Harbor – Cannabis Banking in Uncertain Times’ in 2016, as well as contributed a chapter on cannabis banking in the university textbook ‘The Politics of Marijuana: A New Paradigm’ by Timothy McGettigan.

    I volunteer as a story docent at Admiralty Head Lighthouse. Sailing in from the Pacific Ocean through the treacherous Strait of San Juan de Fuca ship captains would look for the blazing lighthouse beacon 127 feet above Admiralty Inlet warning them to steer a hard right to starboard, avoid the cliffs, and continue safely south to Puget Sound and on into Seattle. 

    How did the captain know he was seeing Admiralty Head Lighthouse? Each lighthouse - no matter where in the world - has its very own distinctive light pattern, or signature. Like your fingerprints. Lighthouses mark points of navigation, warn about dangerous coastlines, and guide ships into safe harbor.

    But no one harbor serves all boats. Different boats - different harbors. Lighthouses don’t chase boats; why do you chase clients?

    Ask yourself: What is it only you have to offer? Who needs it and wants it? How will you attract your particular client with your own distinctive beacon of light? And, how will they know you are signaling them? Once you have your answers, you will be well on your way to business success.  Guaranteed!

    What Now Right Now? Assessment of the EU Schrems II Decision

    The Schrems II decision is a Serious Privacy topic. Privacy professionals in the EU and the US had the 16th of July marked on their calendars for a long time. Today was the day the Grand Chamber of the Court of Justice of the European Union would publish their verdict in the case between the Irish Data Protection Commissioner on the one hand, and Facebook and Max Schrems on the other. The Schrems-II case, as it is commonly known, has made as much of an impact as its predecessor did in 2015.

    On Thursday morning, July 16, the Court invalidated the EU-US Privacy Shield, and seriously restricted the use of standard contractual clauses. Reason enough for a special Serious Privacy episode to discuss the case and what comes next.

    Paul Breitbarth and K Royal talked briefly with Gabriela Zanfir-Fortuna of the Future of Privacy Forum and Sophie in ’t Veld, Dutch member of the European Parliament. We were looking for their reactions to the decision, their expectations, and their recommendations of what happens now. They did not disappoint in providing their insight.
